1. What is Case Analysis? |

Case analysis is the process of examining the facts of a legal dispute and identifying the legal principles that apply to those facts. It involves breaking down a real or hypothetical scenario to understand what went wrong, who is involved, and how the law provides a remedy. In OCR Law, this skill helps you think like a lawyer.

When you analyse a case, you do not simply describe what happened. You must connect the events to specific legal rules and argue whether those rules have been broken. By practising case analysis from Year 7, you develop strong reasoning abilities that will serve you throughout your legal studies.

2. Key Components of a Legal Case |

Every legal case has a few standard building blocks. The claimant is the person or organisation bringing the case and asking for a remedy. The defendant is the party being sued or accused. The facts are the events that gave rise to the dispute, such as dates, actions, and statements made. The legal issue is the question the court must answer, for example, ‘Was there a breach of contract?’

The arguments are the reasons each side gives to support their position, while the decision (or judgment) is the court’s final outcome. Understanding these components allows you to organise your thoughts before you start writing an analysis. Without a clear structure, it is easy to miss important connections between the facts and the law.

3. The IRAC Framework | IRAC框架

IRAC stands for Issue, Rule, Application, and Conclusion. It is the most common method taught to law students for structuring case analysis. First, you spot the legal issue – the precise question that needs to be answered. Next, you state the relevant rule of law, such as the elements of negligence or the requirements for a valid contract.

Then, you apply the rule to the facts of your case, explaining how each part of the rule is or is not satisfied. Finally, you reach a conclusion that answers the legal issue and states who is likely to win. Using IRAC keeps your reasoning logical and ensures you do not skip crucial steps.

4. Case 1: The Wet Floor Problem |

Let us begin with a simple scenario. Sarah visits her local supermarket to buy groceries. In the dairy aisle, there is a large puddle of clear water on the floor that has been there for about an hour. No staff member has placed a warning sign, and the area is not cordoned off. Sarah does not see the water, slips, and falls heavily, breaking her wrist.

Sarah wants to claim compensation for her injury. She believes the supermarket should be held responsible because they did not keep the floor safe. This type of claim falls under the law of tort, specifically negligence. Your task is to analyse whether the supermarket is liable.

5. Case 1: Facts and Issue |

The key facts are: Sarah was a lawful customer in the supermarket; there was a water spillage on the floor; the spill had been present for about an hour, giving the shop time to discover it; no warning signs or barriers were used; Sarah slipped and broke her wrist. These facts are largely undisputed.

The legal issue is: ‘Did the supermarket owe a duty of care to Sarah and breach that duty, causing her injury?’ Another way to frame it is: ‘Is the supermarket liable in negligence for Sarah’s broken wrist?’ Phrasing the issue as a clear question helps you focus on the relevant law.

6. Case 1: Rule and Application |

The rule for negligence requires four elements: the defendant owed the claimant a duty of care; the defendant breached that duty; the breach caused the claimant’s loss or injury; and the loss was not too remote. A duty of care is owed to anyone who might foreseeably be affected by the defendant’s actions. An occupier of a shop owes a duty to keep the premises reasonably safe for customers.

Applying the rule: The supermarket clearly owed Sarah a duty of care as a customer. A reasonable supermarket would regularly check for spills and either clean them up or put out warning signs. The water was present for an hour, so a careful shop should have discovered it. By failing to act, the supermarket breached its duty.

Because of the breach, Sarah slipped on the water and broke her wrist. The injury was a direct physical result of the fall, so causation is established. The damage is not too remote, as falling on a wet floor is a foreseeable consequence. All four elements appear satisfied.

7. Case 1: Conclusion |

The most likely conclusion is that the supermarket is liable for negligence. The court would find that a duty existed, it was breached, and the breach directly caused a recognised injury. Sarah would be entitled to claim damages for her broken wrist, including medical expenses and any loss of earnings.

Even if the supermarket argued Sarah should have looked where she was walking, the lack of signage is strong evidence against them. In OCR style, always conclude by directly answering the legal issue you identified. Here, the answer is yes, the supermarket is liable.

8. Case 2: The Unpaid Debt |

Our second scenario involves contract law. Tom advertised his electric guitar for sale online at a price of £100. Mia saw the advertisement and messaged Tom, saying she would buy the guitar. Mia immediately transferred £100 to Tom’s bank account, and Tom replied, ‘Thanks, I’ll deliver the guitar tomorrow.’ Tom never delivered the guitar and has stopped responding to Mia’s messages.

Mia is very upset. She has paid the money but received nothing. She wants to know if she has any legal right to get her money back or force Tom to deliver the guitar. You need to apply the rules of contract law to analyse her situation.

9. Case 2: Facts, Issue, Rule |

The relevant facts are: Tom offered to sell the guitar for £100; Mia accepted this offer; Mia paid the full price, which is consideration; Tom promised to deliver the guitar; there was a clear commercial arrangement. There is no suggestion of any fraud or mistake about the item itself, only a failure to perform.

The legal issue is: ‘Did a valid contract exist between Tom and Mia, and has Tom breached it?’ To answer this, we need the rule for a valid contract: offer, acceptance, consideration, and an intention to create legal relations. Additionally, a breach occurs when a party fails to perform their obligations under the contract.

The rule also tells us that once a contract is breached, the innocent party can claim remedies, such as damages or, in some circumstances, specific performance, which would force the other party to deliver the promised item.

10. Case 2: Application and Conclusion |

Applying the rule, Tom’s advertisement or his reply could be seen as an offer. Mia’s message and payment constituted acceptance. The money paid is consideration – something of value exchanged between the parties. Since both were serious about the transaction and money changed hands, there was clearly an intention to create legal relations. A valid contract was formed.

Under the contract, Tom was obligated to deliver the guitar. By failing to do so without any lawful reason, he has breached the contract. Mia is entitled to a remedy. The most straightforward remedy is damages – likely the return of her £100. She could also ask the court for specific performance, ordering Tom to hand over the guitar, but this is less common for used items.

The conclusion is that Tom is in breach of a valid contract. Mia should succeed in a claim for her money back. This case illustrates how even simple everyday agreements can create legal rights and responsibilities.

11. Common Pitfalls and How to Avoid Them | 常见陷阱及如何避免

Many students confuse the facts with the legal issue. Remember, facts describe what happened; the issue is the legal question the court must decide. Another mistake is stating a rule without breaking it down into its elements. For example, saying ‘the supermarket was negligent’ is incomplete; you must show duty, breach, causation, and damage.

Students sometimes forget to apply the rule to the facts properly. It is not enough to repeat the rule; you must explain how each part connects to the real events. Also, avoid reaching a conclusion before doing the analysis – let the IRAC steps guide you. Finally, do not ignore facts that seem to go against your conclusion; a strong analysis acknowledges counter-arguments.

12. Practice Exercise with Self-Check |

Here is a new scenario for you to try on your own. Jamie buys a chicken sandwich from the school canteen during lunch. The sandwich contains cheese that is clearly mouldy and smells bad. Jamie takes one bite, notices a strange taste, and later suffers from food poisoning, missing two days of school. The canteen staff claim they checked the sandwiches that morning and saw nothing wrong.

Use the IRAC framework to analyse this case. First, identify the facts and the legal issue. Second, what area of law applies? (Hint: It involves a duty to provide safe food, which could be negligence or a breach of a statutory duty under consumer protection laws). State the relevant rule. Then apply it. Finally, conclude whether Jamie is likely to have a valid claim.

Self-check questions: Did you identify the canteen’s duty to supply food fit for consumption? Did you discuss whether checking in the morning was enough, considering mould could be hidden? Did you link the food poisoning to the sandwich? After writing your analysis, review it against the common pitfalls list above.
