1. The Rule of Law |

The rule of law is the foundation of any fair society — it means everyone, including the government and royalty, must obey the same laws. Imagine a giant umbrella marked ‘Law’ that covers everyone equally.

Equality before the law guarantees identical treatment in the eyes of the law. Visualise a pair of perfectly balanced scales: no matter your status, the scales never tip.

Due process demands that legal procedures be fair and followed correctly. Keep the phrase ‘Do the process right’ in mind.

Separation of powers divides the state into three branches — legislature, executive and judiciary — so no single group has all the control. Think of a three-layered cake; each layer has its own power flavour.

2. Criminal Law vs Civil Law |

Criminal law deals with actions harmful to society: the state prosecutes the accused and punishment can include imprisonment. Link ‘Criminal’ with ‘Captured and punished by the state’.

Civil law resolves disputes between individuals or businesses, seeking remedies like compensation. ‘Civil’ reminds you of ‘civic neighbour’ squabbles — like arguing over a garden fence.

In criminal cases the defendant faces the prosecution; in civil cases the claimant sues the defendant. Remember: a ‘claimant claims’, and a ‘prosecutor protects public peace’.

The standard of proof in criminal law is ‘beyond reasonable doubt’ — a very high bar, like having to fill an Olympic pool with certainty. In civil law the standard is ‘balance of probabilities’ — you only need the scales to tip, even slightly, above 50%.

3. Court Structure |

The Magistrates’ Court deals with minor (summary) offences and preliminary hearings. Magistrates are volunteers; think ‘Magistrates = mini-rate judges for small matters’.

The Crown Court handles serious (indictable) crimes and sits with a judge and jury. Picture a crown sitting on top of the courtroom, reminding you this is where serious justice is served.

The County Court is the workhorse of civil justice, dealing with debt claims, personal injury and contract disputes. Link ‘County’ to ‘Counting money with a county accent’.

The High Court hears the most complex civil cases and some criminal appeals. Its name is a clear clue — it sits higher than the County Court.

Appeal courts review decisions from lower courts. Think of ‘appeal’ as ‘a peel’ — peeling back a layer to check if everything underneath is right.

4. Legal Personnel |

Solicitor: your first port of call for legal advice, document drafting and lower-court representation. ‘Solicitor’ sounds like ‘solace’ — they give solace when you face legal trouble.

Barrister: a specialist advocate who presents your case in higher courts, often robed and wigged. Associate ‘bar’ with the wooden bar they stand behind in court.

Judge: the impartial referee of the court, ruling on law, procedure and sentence. ‘Judge’ is the ‘judgment engine’ — they produce the final decision.

Jury: twelve randomly selected citizens who decide guilt or innocence purely on the facts. ‘Jury’ rhymes with ‘fury’ — their verdict can spark applause or fury.

Magistrate: volunteer lay judges who handle less serious crimes and administrative work. Think ‘Magic-trate’ — they magically resolve small disputes quickly.

5. Sources of Law |

Statute law: Acts of Parliament that are written, debated and passed into law. Picture a ‘statue’ — a stone-carved law that stays standing for years.

Common law: judge-made law built through precedent in court decisions. ‘Common’ reminds you it applies to everyone, like common sense.

Precedent: a court decision that later judges must follow in similar factual situations. Recall ‘precede’ means ‘comes before’, so a previous judgment leads the way.

Delegated legislation: law made by bodies given power by Parliament, such as local councils. Imagine Parliament handing over a ‘legislation remote control’ to specialists.

European Convention on Human Rights: an international treaty that influenced UK law, especially via the Human Rights Act 1998
