Think about the following: Has Harper committed theft? Does he have the actus reus? What about his mens rea – was he dishonest, and did he intend to permanently deprive the owner of the bicycle? Take a moment to form your initial view.

8. Step-by-Step IRAC Analysis | 逐步 IRAC 分析

Issue: The key legal question is whether David Harper is guilty of theft under s.1 of the Theft Act 1968 in relation to the mountain bike.

By moving the bike far from where the owner left it, Harper acted as if he had the right to do so. This could be enough for the court to find the required intention, even if he planned to return it eventually.

Conclusion – Sophie is likely guilty.

Application – Dan’s raised fist and words definitely caused Pat to fear immediate force, so actus reus is present. Dan appeared to intend to frighten Pat, satisfying mens rea. Conclusion – Dan would be guilty of assault even without touching Pat.

Can you find any argument that might help Dan? Perhaps he believed his actions were a joke and Pat would not take them seriously. However, recklessness means that if he foresaw a risk of causing fear and went ahead anyway, he still satisfies mens rea.
