Importantly, the appropriation occurred without Sarah’s consent, and there was no lawful defence such as a claim of right or duress. Therefore, Dan is likely to be convicted of theft. Students should also note that theft is triable either way, but for a smartphone value it would likely be heard in the magistrates’ court.
