1. Syllabus Overview and Assessment |
The Edexcel GCSE Law qualification is divided into two equally weighted examination papers, each carrying 50% of the total marks. Paper 1 examines The English Legal System and Criminal Law, while Paper 2 examines The English Legal System and Tort Law. Both papers last 1 hour 45 minutes and feature a common structure: a mix of multiple-choice questions, short-answer knowledge questions, scenario-based application questions and extended 9‑mark evaluation essays. The English Legal System content is identical in both papers, meaning your knowledge of courts, personnel and law-making is tested twice, so mastery of this area really pays off.
2. The English Legal System: Courts and Hierarchy |
The court structure in England and Wales is hierarchical, with lower courts bound by the decisions of higher courts. For criminal cases, the Magistrates’ Court hears summary offences and some either-way offences, while the Crown Court deals with serious indictable offences and trials on indictment. Appeals from the Magistrates’ Court go to the Crown Court or, on points of law, to the High Court’s Queen’s Bench Division. From the Crown Court, appeals are heard by the Court of Appeal (Criminal Division) and ultimately the Supreme Court.
Civil cases follow a parallel track. The County Court hears small claims and fast-track cases, while the High Court deals with more complex or high‑value claims and also exercises supervisory jurisdiction over lower courts and tribunals. Appeals lie to the Court of Appeal (Civil Division) and thereafter to the Supreme Court. The key appeal routes can be summarised as follows:
- Criminal: Magistrates’ ⇨ Crown Court ⇨ Court of Appeal (Criminal) ⇨ Supreme Court
- Civil: County Court/High Court ⇨ Court of Appeal (Civil) ⇨ Supreme Court
3. Sources of Law: Statute, Precedent and Delegated Legislation |
Law in England and Wales comes from several formal sources. Primary legislation consists of Acts of Parliament, which are proposed as Bills, debated in the House of Commons and House of Lords, and receive Royal Assent. Delegated legislation—such as statutory instruments, bylaws and Orders in Council—allows government ministers or other bodies to make law under powers given by a parent Act, enabling detailed rules to be created without a new full Act.
Judicial precedent is a fundamental common law source. The doctrine of stare decisis requires lower courts to follow the ratio decidendi—the legal reasoning essential to the decision—of higher courts. The Supreme Court can depart from its own previous decisions using the Practice Statement 1966, but the Court of Appeal is generally bound by its own past rulings. Statutory interpretation rules also shape how judges apply Acts of Parliament: the literal rule, the golden rule, the mischief rule and the purposive approach each give different weight to the words and intention of Parliament.
4. Legal Personnel: Judges and Lawyers |
The legal profession in England and Wales is divided primarily between solicitors and barristers. Solicitors provide legal advice directly to clients, handle preparatory work and may represent clients in lower courts. Barristers specialise in advocacy and are often instructed by solicitors to present cases in higher courts. Both are regulated by their own professional bodies and after qualification must comply with ongoing training requirements.
Judges are appointed from experienced lawyers. The hierarchy of judges mirrors the court structure: magistrates sit in the Magistrates’ Court, District Judges in the County Court and Magistrates’ Court, Circuit Judges in the Crown Court and County Court, High Court Judges in the High Court, Lord Justices of Appeal in the Court of Appeal, and Justices of the Supreme Court. Judicial independence is constitutionally protected; judges are appointed by an independent commission and their decisions cannot be overturned by the government, which upholds the separation of powers.
5. Lay People in the Law: Juries and Magistrates |
Lay people play a vital role in the English legal system. Juries in the Crown Court decide questions of fact and deliver a verdict of guilty or not guilty after listening to the evidence and the judge’s summing‑up. The Juries Act 1974 sets out eligibility criteria, and random selection from the electoral register ensures a cross-section of the community. Juries deliberate in secret and their verdicts can be majority‑based (10–2 or 9–1) after a prescribed period.
Magistrates, also known as Justices of the Peace, are volunteers who sit in the Magistrates’ Court, usually in panels of three. They handle over 90% of criminal cases, including summary trials, bail applications and allocation decisions. Magistrates receive training but are not legally qualified; they are advised on law and procedure by a legally qualified justices’ clerk. Their role exemplifies public participation in the administration of justice.
6. Criminal Law: Actus Reus and Mens Rea |
Most criminal offences consist of two essential elements that the prosecution must prove beyond reasonable doubt: the actus reus (the guilty act) and the mens rea (the guilty mind). The actus reus can be an act, an omission where a duty to act exists, or a state of affairs. The mens rea varies by offence and may include intention, recklessness, negligence or knowledge. The basic equation for liability can be expressed as:
Actus reus + Mens rea → Criminal liability
Causation is a key part of actus reus in result crimes. The prosecution must establish both factual causation (the ‘but for’ test: but for the defendant’s conduct, would the result have occurred?) and legal causation (the defendant’s act was the operating and substantial cause of the harm, with no intervening act breaking the chain of causation). Thin skull rule means the defendant must take the victim as they find them, even with unforeseen vulnerabilities.
7. Non-Fatal Offences Against the Person |
The main non‑fatal offences are assault, battery, assault occasioning actual bodily harm (ABH) under section 47 of the Offences Against the Person Act 1861, and grievous bodily harm (GBH) under sections 20 and 18 of the same Act. Assault is causing the victim to apprehend immediate unlawful force, while battery is the actual infliction of unlawful force. Both can be committed intentionally or recklessly and are common law offences.
Section 47 ABH requires proof of assault or battery that causes ‘actual bodily harm’, which can be any hurt or injury calculated to interfere with the health or comfort of the victim, including psychiatric harm. Section 20 GBH requires maliciously wounding or inflicting grievous bodily harm, where mens rea is intention or recklessness as to ‘some harm’. Section 18 GBH is the most serious: causing grievous bodily harm with intent to cause GBH or to resist/prevent arrest, carrying a maximum life sentence. Distinguishing the mens rea for each offence in a scenario is a fundamental exam skill.
8. Property Offences: Theft, Robbery and Burglary |
The Theft Act 1968 defines theft under section 1 as the dishonest appropriation of property belonging to another with the intention of permanently depriving the other of it. Each element must be proved: appropriation (assuming rights of an owner), property (including money, intangible property, but not information), belonging to another, dishonesty (tested by the Ivey test) and intention to permanently deprive (treating the property as one’s own to dispose of).
Robbery under section 8 is theft aggravated by the use or threat of force immediately before or at the time of stealing, and in order to steal. The force must be directed against a person and can be minimal, but the theft must be completed or attempted. Burglary under section 9 involves entering a building or part of a building as a trespasser with intent to commit theft, GBH or criminal damage, or having entered, committing such an offence. The entry must be effective and the defendant must know or be reckless as to trespassing.
9. General Defences in Criminal Law |
Even when the actus reus and mens rea of an offence are proved, the defendant may avoid liability by raising a defence. Self‑defence (including defence of another) is available where the defendant used force that was reasonable in the circumstances as they honestly believed them to be. The force must be both necessary and proportionate, though in the ‘agony of the moment’ a degree of latitude is allowed.
Intoxication is treated differently depending on whether it is voluntary or involuntary. Voluntary intoxication can negate specific intent crimes (like section 18 GBH) if the defendant lacked the required intent, but it is no defence to basic intent crimes. Insanity raises the M’Naghten Rules: the defendant must prove on a balance of probabilities a defect of reason from a disease of the mind, causing them not to know the nature and quality of the act or that it was wrong. Duress by threats and duress of circumstances are also available in narrow conditions, excluding murder and some other serious offences.
10. Tort Law: Duty of Care and Negligence |
Tort law deals with civil wrongs, and the dominant tort in the syllabus is negligence. To establish negligence, a claimant must prove that the defendant owed them a duty of care, breached that duty, and the breach caused reasonably foreseeable damage. The duty of care is established using the Caparo three‑part test: foreseeability of damage, proximity between the parties, and whether it is fair, just and reasonable to impose a duty. The basic structure of negligence can be remembered as:
Duty of care + Breach + Causation + Damage → Negligence
Breach of duty is assessed against the standard of the reasonable person. The court considers factors such as the likelihood of harm, the seriousness of the potential injury, the cost and practicality of taking precautions, and any social utility of the defendant’s conduct. The Bolam test applies a professional standard where the defendant professes a special skill. Causation must be proved on the balance of probabilities, and the damage must not be too remote—the kind of damage must be reasonably foreseeable.
11. Occupiers’ Liability |
Occupiers’ liability is a statutory tort that governs the duty owed by occupiers of premises to persons who enter those premises. The Occupiers’ Liability Act 1957 covers lawful visitors, while the Occupiers’ Liability Act 1984 covers trespassers. Under the 1957 Act, an occupier owes a common duty of care to take such care as is reasonable to see that visitors are reasonably safe in using the premises for the purpose for which they were invited.
The 1984 Act imposes a more limited duty towards trespassers. An occupier owes a duty only if they are aware of the danger or have reasonable grounds to believe it exists, know or have reasonable grounds to believe a trespasser may come into the vicinity of the danger, and the risk is one against which, in all the circumstances, they may reasonably be expected to offer some protection. The duty is to take such care as is reasonable to see that the trespasser does not suffer injury on the premises. Defences include contributory negligence and volenti non fit injuria (consent).
