Remember that no matter the formula, the Human Rights Act 1998 requires judges, where possible, to read legislation compatibly with Convention rights.

In some civil proceedings involving serious allegations (e.g., fraud), the court applies the Bater v Bater principle, which requires clear evidence commensurate with the gravity of the allegation, but still on the balance of probabilities.

The egg‑shell skull (thin skull) rule applies once causation is established: victims must be taken as found, so a pre‑existing vulnerability does not excuse the defendant from full liability.
