📚 Case Analysis Masterclass |

In Eduqas GCSE Law, mastering case analysis is the key to exam success. Whether you are tackling criminal law, tort, or contract questions, you need a clear and structured method to apply legal principles to factual scenarios. This practical guide will walk you through the IRAC (Issue, Rule, Application, Conclusion) technique, and then let you practise with worked examples and a self-test exercise. By the end, you will feel confident breaking down any case study under timed conditions.

1. What is Case Analysis? |

Case analysis in GCSE Law means reading a short factual scenario and answering a question by identifying the relevant legal issues. You are not simply retelling facts; you must explain how the law applies, using proper legal terminology and, where possible, named cases or statutes. Eduqas exam papers often present a problem scenario followed by questions like ‘Discuss the criminal liability of Dan’ or ‘Advise Sam on his rights in contract law.’ Your job is to construct a logical legal argument.

2. The IRAC Method | IRAC法

The IRAC method provides a four-step framework that markers love to see. IRAC stands for Issue, Rule, Application, and Conclusion. Start by pinpointing the legal issue; then state the rule of law that governs that issue; apply the rule to the specific facts of the case, explaining why it does or does not lead to liability; finally, reach a reasoned conclusion. Using IRAC keeps your answer focused and prevents you from missing key points.

3. Identifying the Legal Issues |

The first step is to ask, ‘What area of law is involved?’ Read the scenario carefully and underline any actions that could be criminal acts, breaches of duty, or broken promises. Common issues include: Did D cause the victim to fear immediate unlawful force? (assault) Did D owe a duty of care? (negligence) Was there a valid offer and acceptance? (contract). Frame the issue as a question, such as ‘Is Dan liable for assault against Eve?’

4. Stating the Relevant Rules |

Once the issue is clear, write down the legal rule. This needs to be precise and supported by authority. For example, the rule for assault is ‘an act which intentionally or recklessly causes another person to apprehend immediate and unlawful personal violence.’ You can cite the case of R v Ireland (1997) and section 39 of the Criminal Justice Act 1988. In negligence, the neighbour principle from Donoghue v Stevenson (1932) sets out the duty of care. Use the table below to quickly recall key definitions.

Key Rule / Case
Assault 袭击 Intentionally/recklessly causing V to apprehend immediate unlawful force; s.39 CJA 1988, R v Ireland
Battery 殴打 Intentional/reckless application of unlawful force; Collins v Wilcock
Duty of care (neighbour principle), breach, causation, damage; Donoghue v Stevenson, Caparo v Dickman
Offer 要约 Clear expression of willingness to contract on stated terms; Carlill v Carbolic Smoke Ball
Acceptance 承诺 Unconditional agreement to all terms of offer; must be communicated; Felthouse v Bindley

5. Applying Rules to Facts |

This is where you earn the most marks. Take each element of the rule and link it to a specific fact. Avoid general statements like ‘Dan is guilty because he committed assault.’ Instead, say ‘By raising his fist and shouting, Dan intentionally caused Eve to believe she would be hit immediately. The fact she screamed and stepped back shows she apprehended immediate violence.’ Always use the facts given and do not invent new ones.

6. Reaching a Reasoned Conclusion |

Your conclusion must flow logically from your application. It is not enough to say ‘liable’ or ‘not liable’; you should briefly summarise why. For instance, ‘Therefore, Dan is liable for assault because his intentional act caused Eve to apprehend immediate unlawful force, satisfying all elements.’ Even if there is ambiguity, state the most likely outcome and explain any alternative arguments.

7. Worked Example: Criminal Law – Assault |

Facts: Dan and Eve are neighbours. During an argument, Dan shouts ‘I’m going to smash your face in!’ and runs towards Eve with his fist raised. Eve, terrified, screams and runs into her house. Dan stops at the gate and does not actually touch her.

Issue: Is Dan criminally liable for assault against Eve?

Rule: Assault is defined as an act that intentionally or recklessly causes another person to apprehend immediate and unlawful personal violence. The offence is charged under s.39 Criminal Justice Act 1988. Silence or words can also constitute an assault, as established in R v Ireland (1997), where silent phone calls were held capable of causing apprehension. The victim must actually apprehend immediate force, but actual physical contact (battery) is not required.

Application: Dan intentionally shouted threatening words and raised his fist while running towards Eve. This conduct was meant to cause fear of immediate violence. Eve indeed apprehended immediate unlawful force—she screamed and fled, showing genuine fear. The immediacy requirement is met because Dan was advancing on her and there was nothing to suggest the threat was distant or conditional. The fact that Dan stopped at the gate does not negate the assault; at the moment Eve feared the imminent blow, the offence was complete.

Conclusion: Dan is likely to be found guilty of assault. All elements are satisfied: an intentional act, causing another to apprehend immediate unlawful violence, with no lawful excuse.

8. Worked Example: Tort Law – Negligence |

Facts: MegaStore supermarket leaves a wet floor sign near a spillage in aisle 3, but the sign is small and partly hidden by a stack of goods. Mrs Patel, a customer, does not see the sign, slips on the wet patch, and breaks her wrist. She wishes to claim compensation.

Issue: Is MegaStore liable in negligence for Mrs Patel’s injury?

Rule: To establish negligence, a claimant must prove: (1) the defendant owed a duty of care; (2) the defendant breached that duty; (3) the breach caused the damage; and (4) the damage was not too remote. The duty of care is based on the neighbour principle from Donoghue v Stevenson (1932): one must take reasonable care to avoid acts or omissions likely to injure a neighbour. The standard of care is that of the reasonable person, and for occupiers, the Occupiers’ Liability Act 1957 requires a common duty of care to visitors. Breach occurs if the defendant falls below the standard of a reasonable person in the circumstances; factors like the magnitude of risk and the cost of precautions are considered.

Application: MegaStore, as an occupier, owed Mrs Patel a common duty of care under the 1957 Act. A reasonable supermarket would place a clearly visible, large warning sign and promptly clean up spills. Here, the sign was small and hidden, and the spill remained unattended. This clearly fell below the reasonable standard, constituting a breach. The breach directly caused Mrs Patel’s fall and broken wrist. The injury is a reasonably foreseeable consequence of leaving a wet floor with an inadequate warning, so the damage is not too remote. No contributory negligence appears on the facts.

Conclusion: MegaStore is liable in negligence. Mrs Patel should succeed in her claim for damages.

9. Practice Scenario: Contract Law – Offer and Acceptance |

Scenario: On Monday, Amy texts Ben: ‘Will sell my guitar for £100 cash if you want it.’ Ben replies: ‘I can only pay £80.’ Amy says: ‘No, price is firm.’ On Tuesday, Ben sends a text: ‘OK, I agree to pay £100.’ Amy has now sold the guitar to someone else. Advise Ben whether a binding contract was formed.

Hints / 提示:

  • Identify the legal issue: Was there a valid offer and acceptance?
  • Rule: An offer can be revoked before acceptance. A counter-offer destroys the original offer (Hyde v Wrench). Acceptance must be unconditional and communicated.
  • Application: Amy’s first message was an offer. Ben’s reply of £80 was a counter-offer, terminating the original offer. Amy’s ‘No’ confirmed the offer was dead. Ben’s later agreement to £100 was a new offer, which Amy did not accept.
  • Conclusion: No binding contract.

10. Common Mistakes to Avoid |

Even strong students lose marks by not fully engaging with the facts. Do not simply recite the law without linking it to the scenario. Avoid missing elements: in negligence, remember to discuss all four stages. Never confuse criminal and civil terminology—assault is a crime and also a tort, but make sure you use the correct context required by the question. Also, do not write in bullet points for the whole answer; Eduqas examiners expect continuous prose. Use the IRAC structure as paragraphs to show a flowing argument.

11. Exam Tips for Eduqas GCSE Law | Eduqas GCSE

In the Eduqas GCSE Law exams, case study questions often appear in both Component 1 (English Legal Systems and Criminal Law) and Component 2 (Civil Law). Always note the marks available; for higher-mark questions (e.g., 8 or 10 marks), your analysis must be detailed and fully developed. Time management is vital: allocate roughly 1.5 minutes per mark. Before writing, quickly jot down the issue, rule, and key facts to structure your answer. Finally, use authoritative sources—mentioning a relevant case or statute can lift your answer into the higher mark bands.

12. Conclusion | 结语

Case analysis is a skill that improves with practice. By consistently using the IRAC method and paying close attention to facts, you can turn a daunting problem question into a straightforward exercise in legal reasoning. Keep working through past paper scenarios, and soon you will be able to spot issues and apply the law almost instinctively. Remember, every problem scenario is an opportunity to demonstrate your legal knowledge clearly and logically.
