Case analysis is the beating heart of the English legal system. Because much of our law is judge-made, understanding how judges reason and bind future courts is essential for any A2 law student. It is not only about memorising case names but about learning to think like a lawyer.

Before you can analyse a case, you must know how to read a law report. A typical modern report contains a headnote, a list of catchwords, the procedural history, the facts, the arguments of counsel, and the judgments. The headnote summarises the legal outcome, but you should never rely on it alone—it can occasionally be misleading.

Material facts are those that directly influence the legal outcome. A fact is material if, had it been absent, the court would have reached a different decision. In Donoghue v Stevenson [1932] AC 562, the fact that the ginger beer bottle was opaque and could not be inspected by the consumer was material because it stopped the manufacturer from arguing that the pursuer should have spotted the snail herself.

The legal issue is the precise question the court must answer. It is often framed in terms of a legal principle rather than a factual dispute. For example, in Carlill v Carbolic Smoke Ball Co [1893] 1 QB 256, the issue was not merely whether Mrs Carlill was entitled to £100, but whether a general advertisement could constitute a binding unilateral offer to the whole world.

Lord Denning’s judgments are famous for their imaginative obiter, some of which later became law. The key difference is that a later court may choose to follow or reject obiter; it has no obligation to do so.

In your exam answers, you must be able to label a statement as ratio or obiter and explain the consequences of the classification. A common trap is to treat everything a judge says as binding. Instead, ask: ‘Was this point disputed by the parties?’ and ‘Did the judge absolutely need to decide this point to resolve the case?’ If the answer is no, it is likely obiter.

The doctrine of precedent, or stare decisis, requires lower courts to follow the ratio of higher courts within the same hierarchy. This promotes certainty, consistency and fairness in the law. However, the system is flexible enough to allow distinguishing and overruling when justice demands it. A Level candidates should be able to explain how the doctrine operates in both civil and criminal divisions.

Understanding the Practice Statement and its cautious application in cases like Pepper v Hart [1993] AC 593 is important for top-grade analysis.

For your exam, you must be able to predict which court will be bound in a hypothetical scenario. A common examination technique is to give you a chain of decisions and ask you to argue whether a particular ratio remains good law or has been impliedly overruled.

9. Distinguishing, Reversing and Overruling | 区分、撤销与推翻

Courts may avoid a seemingly binding precedent through distinguishing, where the material facts of the present case are held to be sufficiently different from those of the earlier case. This is not a rejection of the precedent but a technique to narrow its scope. In Balfour v Balfour [1919] 2 KB 571, the court distinguished domestic agreements from commercial arrangements, thus limiting the presumption of intention to create legal relations.

For example, the Supreme Court overruled the fifty-year-old rule on joint enterprise in R v Jogee [2016] UKSC 8, fundamentally reshaping accessorial liability.

Many cases that you will analyse involve the interpretation of statutes. The role of the judge is to give effect to Parliament’s intention using the rules of interpretation: the literal rule, golden rule, mischief rule and the purposive approach. Once a higher court interprets a statutory provision, that interpretation becomes a binding precedent for the meaning of the legislation.

This has generated a significant body of precedent that blends statutory interpretation with human rights reasoning, as seen in Ghaidan v Godin-Mendoza [2004] UKHL 30, where the House of Lords read the Rent Act 1977 to include same-sex partners as surviving spouses.

This has added a new layer to the doctrine of precedent, as the duty to follow precedent may be tempered by the duty under section 6 of the HRA to act compatibly with Convention rights.

The manufacturer argues that they cannot be liable because no human driver was involved. The court must decide whether the rule in Donoghue v Stevenson can be extended to cover an autonomous system that operates through algorithms rather than physical products.
