The most effective framework for tackling law case studies is IRAC: Issue, Rule, Application, and Conclusion. First, identify the legal issue in the scenario. Second, state the relevant legal rule or principle. Third, apply the rule to the facts of the case. Finally, reach a reasoned conclusion.

Scan for trigger words like ‘intention’, ‘agreement’, ‘duty of care’, ‘actus reus’, ‘damage’, or ‘offer’.

The offence is complete upon causing the victim to fear imminent battery. Dan’s actions indicate at least recklessness as to causing such fear; a reasonable person would foresee that raising a fist and verbalising a threat would frighten someone. Applying the principles from R v Ireland, the combination of threatening words and a physical gesture is more than sufficient to satisfy the elements of assault.
