1. Core Criminal Law Vocabulary |

Actus reus refers to the physical element of a crime – the act, omission, or state of affairs that the law prohibits. Memory tip: ‘Actus’ sounds like ‘act’.

Mens rea is the mental element, meaning a guilty mind or fault. It covers intention, recklessness, and sometimes negligence. Think ‘M’ for ‘mind’.

Strict liability offences require no proof of mens rea for at least part of the actus reus. The defendant can be convicted just by committing the act, such as selling food past its use‑by date.

Causation links the defendant’s act to the consequence. Factual causation uses the ‘but for’ test, while legal causation asks whether the harm was the sufficiently direct result.

Intention can be direct, where the defendant aims to bring about a result, or oblique, where the result is virtually certain and the defendant appreciates that.

Recklessness involves taking an unjustifiable risk that a reasonable person would not take, while being aware of the risk.
