1. Q1: Actus Reus of Assault |

Question: Define the actus reus of assault and explain, with reference to a decided case, how words alone can satisfy this element. (4 marks)

Model Answer: The actus reus of assault is any act which causes the victim to apprehend immediate and unlawful personal violence. No physical contact is required; it is the creation of a fear of immediate force. In R v Ireland [1997], the defendant made repeated silent phone calls to the victim, causing her to fear that he would approach her house imminently. The House of Lords held that silent phone calls could amount to an assault because they caused the victim to apprehend immediate violence. This shows that words, or even silence combined with a course of conduct, can constitute the actus reus of assault as long as the apprehension of immediate force is reasonable.

Examiner’s tip: Many students forget that ‘immediate’ does not mean instantaneous; the victim’s apprehension of violence at some point in the near future can suffice. Always link a case like Ireland to the definition. Avoid drifting into battery by discussing physical contact—keep the focus on causing fear.

2. Q2: Actus Reus of Battery |

Question: Outline the actus reus of battery and illustrate its scope by citing a case where indirect physical contact was sufficient. (4 marks)

Model Answer: The actus reus of battery is the infliction of unlawful physical force upon another person. Even the slightest touching can suffice, and the force can be applied indirectly. In DPP v K [1990], a schoolboy poured acid into a hand dryer; another pupil used the dryer and was burned. The Divisional Court held that applying force indirectly, by setting a trap or using an instrument, still constituted battery. This demonstrates that the defendant need not personally touch the victim; causing an object or substance to make contact is enough.

Common mistake: Students often state that battery requires physical contact directly by the defendant, missing the trap/weapon principle from DPP v K and Haystead v Chief Constable of Derbyshire. Always clarify that battery covers the ‘application’ of force, not necessarily a direct assault.

3. Q3: Definition of Actual Bodily Harm (ABH) |

Question: Explain the meaning of ‘actual bodily harm’ under s.47 Offences Against the Person Act 1861, using case law to show what types of injury are included. (5 marks)

Model Answer: Under s.47 OAPA 1861, ABH means any hurt or injury calculated to interfere with the health or comfort of the victim. It need not be permanent but must be more than trivial. In R v Miller [1954], the court defined ABH broadly, including a hysterical and nervous condition. Psychiatric injury can amount to ABH, as confirmed in R v Chan-Fook [1994], provided it is a recognised clinical condition, not mere emotions such as fear or panic. Cuts, bruises, loss of hair (DPP v Smith [2006]) and temporary unconsciousness (T v DPP [2003]) all qualify. The injury must be caused by the defendant’s assault or battery.

Examiner’s advice: In defining ABH, avoid the trap of simply translating the words; bring in the ‘health or comfort’ test from Miller and demonstrate understanding of how broadly the courts interpret this element. Distinguish psychiatric injury from normal emotional distress.

4. Q4: Maliciously in s.20 Grievous Bodily Harm |

Question: Explain the meaning of ‘maliciously’ in s.20 OAPA 1861, referring to a key case. (4 marks)

Model Answer: In s.20, ‘maliciously’ does not require ill will or spite; it means that the defendant must intend to do the particular kind of harm that was caused, or be reckless as to whether such harm would occur. The test for recklessness is subjective, derived from R v Cunningham [1957]: the defendant must have foreseen the risk of some harm (not necessarily serious harm) and nevertheless taken that risk. This is known as Cunningham recklessness. For example, if D pushes V, foreseeing a risk of some physical harm, and V falls and sustains a wound, D is malicious under s.20 even if he did not desire the precise injury.

Key point: Confusion often arises between s.20 maliciously and the stricter mens rea of s.18 (intention to cause GBH). S.20 only requires foresight of some harm, not necessarily serious harm. Always mention Cunningham and the subjective test.

5. Q5: Scenario Question – Assault and Battery leading to ABH |

Question: Ahmed and Ben are arguing in a pub. Ahmed shouts, ‘I’m going to break your nose right now,’ and steps forward with a clenched fist. Ben, terrified, stumbles backwards and knocks over a stool, cutting his arm. Discuss Ahmed’s potential criminal liability for non-fatal offences. (10 marks)

Model Answer: Ahmed can be liable for assault when he shouts and steps forward with a clenched fist, as this creates in Ben an apprehension of immediate unlawful violence (R v Ireland; Smith v Superintendent of Woking Police Station). The actus reus of assault is satisfied by the words and conduct causing fear of an imminent attack. For mens rea, Ahmed must have intended to cause Ben to fear immediate violence or been reckless as to this (R v Venna). The facts suggest intention to frighten.

Battery may also be established on an indirect basis. Although Ahmed did not touch Ben directly, his threatening action caused Ben to fall and injure himself, applying force indirectly (DPP v K; Haystead). The cut from the stool amounts to actual bodily harm. Since Ben suffered an injury that interfered with his comfort, s.47 ABH can be charged. The actus reus of ABH requires proof of an assault or battery causing ABH (R v Roberts). The chain of causation is not broken because Ben’s reaction was a foreseeable response to a threat (R v Roberts). Mens rea for s.47 is the mens rea of the underlying assault or battery; no additional mens rea as to the harm is required (R v Savage; DPP v Parmenter). Ahmed will be liable for s.47 ABH.

Examiner commentary: To gain full marks, candidates must identify the offences in turn, apply the law to the facts, discuss causation, and cite relevant authorities. A logical structure of assault → battery → ABH works best. Do not forget to explain why the ABH charge is available rather than jumping directly to it.

6. Q6: Scenario Question – GBH s.20 and s.18 |

Question: During a robbery, Maria deliberately hits a shopkeeper over the head with a heavy torch, causing a fractured skull and brain damage. She claims she only wanted to stun him so she could escape. Analyse Maria’s liability for the shopkeeper’s injuries, distinguishing between s.18 and s.20 OAPA 1861. (12 marks)

Model Answer: The shopkeeper’s fractured skull and brain damage clearly amount to grievous bodily harm (GBH), meaning really serious harm (DPP v Smith). Maria is at least liable under s.20. The actus reus of s.20 requires unlawfully wounding or inflicting GBH. A wound (a break in the continuity of the whole skin) is likely present, but the fractured skull is clearly GBH. The mens rea for s.20 is maliciously, meaning Maria must intend some harm or be subjectively reckless as to causing some harm (R v Cunningham). She admits she wanted to stun him, indicating she foresaw some harm, which satisfies s.20. The fact she did not intend serious harm is irrelevant for s.20.

Maria could also be liable under s.18. This offence has the same actus reus: wounding or causing GBH. However, the mens rea is specific: she must intend to cause GBH, or intend to resist or prevent the lawful apprehension of any person and cause GBH with that intention. On the given facts, Maria hit the shopkeeper with a heavy torch on the head—a vulnerable area—suggesting she may have had at least oblique intention to cause really serious harm (R v Woollin). If the jury find that GBH was a virtual certainty of her actions and she appreciated this, s.18 is established. However, if they accept her claim that she only intended to stun, s.18 will fail and s.20 will apply. S.18 carries a maximum life sentence, so it is significantly more serious.

Examiner tip: Always address both sections, outlining the elements and contrasting the mens rea. Use the Woollin direction for oblique intent when discussing s.18. Do not read ‘GBH’ as equal to ‘intention to cause GBH’; s.20 requires only malice. Good answers will discuss the evidential burden of proving s.18 intent.

7. Q7: Defence of Consent in Non-Fatal Offences |

Question: Evaluate the extent to which the defence of consent is available for non-fatal offences against the person, referring to leading cases. (10 marks)

Model Answer: Consent is generally a defence to assault and battery, as everyday touchings are impliedly consented to (Collins v Wilcock). However, for more serious harm, the availability of consent is restricted by public policy. In R v Brown [1994], the House of Lords held that consent cannot be a defence to s.47 or s.20 where the harm was caused for sadomasochistic pleasure, as it was not in the public interest. The case established that consent is only available where the activity falls into a recognised exception: properly conducted games and sports, reasonable surgical interference, tattooing and body piercing, and rough horseplay.

Later cases have clarified the boundaries. In R v Wilson [1997], a husband branding his wife’s buttocks with her consent was held to be akin to tattooing, thus not criminal. In R v Barnes [2005], a tackle in an amateur football match that caused serious injury was still within the implied consent of the sport, provided the act was not so gravely reckless as to be criminal. The defence is assessed contextually. Nevertheless, the law remains uncertain and inconsistent, as Brown has been strongly criticised for criminalising private consensual behaviour. Law reform proposals suggest consent should be a defence if the defendant reasonably believed in consent and the harm was not intended to cause serious injury, but Parliament has not acted.

Critique: The current law prioritises paternalistic moral judgment over individual autonomy. The exceptions are inconsistently drawn; boxing causes deliberate brain damage yet is legal, while consensual BDSM scarring is not. Answers should argue for a clearer statutory framework, perhaps along the lines of the Law Commission’s 1993 proposals, while acknowledging the tension between protecting individuals and respecting freedom.

8. Q8: Evaluation and Reform of Non-Fatal Offences |

Question: Critically assess the current law on non-fatal offences against the person and discuss whether codification and reform are necessary. (15 marks)

Model Answer: The law is based on the Offences Against the Person Act 1861, which is archaic, poorly structured, and uses outdated terminology such as ‘maliciously’ and ‘grievous bodily harm’. The hierarchy of offences (assault, battery, ABH s.47, s.20, s.18) is not logical: s.47 can be committed with the same actus reus as common assault yet carries a five-year maximum sentence. The mens rea requirements do not always correspond to the severity of the harm; for s.47, no mens rea as to the harm is needed, which offends the principle of fair labelling.

The Law Commission in its 1993 report proposed a draft Criminal Law Bill, replacing existing offences with a simplified structure: intentionally causing serious injury, recklessly causing serious injury, intentionally or recklessly causing injury, and assault. This would clarify the mental elements and ensure the label matches the wrong. Despite broad academic support, governments have not enacted these reforms, largely due to the perceived difficulty of changing such entrenched legislation.

On the other hand, the courts have managed to adapt the old statute using creative interpretation, as seen in Ireland, Chan-Fook, and DPP v Smith. The law works in practice, and wholesale reform could create new uncertainties. The principle of parliamentary sovereignty means judges cannot legislate; a statutory overhaul is needed to achieve coherence. A revitalised reform project, such as that proposed by the Law Commission in 2015 on the Sentencing Code and related areas, should include a new non-fatal offences act that reflects modern values, incorporates the subjective Cunningham test, and ensures proportionate sentencing. In conclusion, while the current law functions, its lack of clarity and fairness strongly justifies comprehensive codification.

Top-level response: To reach the highest marks, answers must not just describe the problems but balance them against counter-arguments, and engage with specific reform proposals, citing academic commentary. Referencing the ‘ladder of offences’, the half-century of stalled reform, and the potential for a ‘modern, principled’ approach will demonstrate critical awareness.
