Civil law, unlike criminal law, is concerned with disputes between individuals and aims to compensate rather than punish.

Law in England and Wales comes mainly from two sources: legislation made by Parliament and judicial precedent developed by the courts. Legislation includes Acts of Parliament (primary legislation) and delegated legislation such as statutory instruments and by-laws made by government ministers or local authorities under powers granted by an enabling Act. You need to know the legislative process, from the Green Paper to royal assent, and be able to discuss the advantages and disadvantages of delegated legislation.

Judicial precedent, or stare decisis, means that lower courts must follow the legal principles established by higher courts in previous cases. The binding part of a judgment is called the ratio decidendi (the reason for the decision), while other remarks are obiter dicta (things said by the way). The Supreme Court normally binds all courts below it, but since 1966 it has had the power to depart from its own previous decisions when it appears right to do so, using the Practice Statement.

The law of tort deals with civil wrongs, providing remedies for those harmed by another’s actions. For AS, the focus is the tort of negligence, which requires the claimant to prove three elements: (1) the defendant owed them a duty of care; (2) the defendant breached that duty by falling below the standard of a reasonable person; and (3) the breach caused damage that is not too remote. The classic authority is Donoghue v Stevenson, which established the neighbour principle for duty of care.

Start with short, well-known cases such as R v Dudley and Stephens (the lifeboat case) or Miller v Jackson (cricket balls and nuisance). Summarise each case in your own words, and practise drawing a line between binding precedent and persuasive commentary.

This will build the application skills that are crucial for AO2.

Always incorporate case names, statutory references and academic commentary where relevant.

Ask yourself: does the current law work well? What are its flaws? What reform proposals exist? These questions are at the heart of AO3 and will separate high-scoring answers from the rest.

Even if you did not take GCSE Law, subjects such as History or English Literature develop the analytical and essay-writing skills that are equally valuable here.
