1. Sources of Law | 法律的渊源

English law comes primarily from Acts of Parliament (statute law), judicial decisions (common law or case law), and delegated legislation. Statute law is made by Parliament and is the highest form of domestic law. Common law is developed by judges through the doctrine of judicial precedent, where decisions in higher courts bind lower courts in similar cases. Delegated legislation is law made by other bodies under powers given by an Act of Parliament; it includes statutory instruments, bylaws, and Orders in Council.

A crime generally requires two core elements: the actus reus (guilty act) and the mens rea (guilty mind). The actus reus can be an act, an omission where there is a duty to act, or a state of affairs. Mens rea refers to the mental state — such as intention, recklessness, or negligence — depending on the definition of the offence. Both elements must coincide in time for liability to arise.

Strict liability offences are exceptions where the prosecution does not need to prove mens rea for at least one element of the actus reus. These are often regulatory crimes, such as sale of alcohol to underage persons or driving without insurance. The defendant may be convicted even if they were unaware of the facts and made reasonable efforts to comply with the law.

Assault and battery are common law offences. Assault is an act that intentionally or recklessly causes the victim to apprehend imminent unlawful violence. No physical contact is needed. Battery is the intentional or reckless application of unlawful force upon another, even slight touching. Both can be charged under section 39 of the Criminal Justice Act 1988.

More serious are statutory offences under the Offences Against the Person Act 1861. Section 47 creates the offence of assault occasioning actual bodily harm (ABH). Mens rea is the same as for assault or battery — intent or recklessness as to the initial contact, but no need to intend the harm.

Section 18 is the more serious offence of causing GBH with intent — the defendant must specifically intend to cause serious harm. Both carry substantial maximum sentences.

5. Property offences | 财产犯罪

Theft is defined in section 1 of the Theft Act 1968 as the dishonest appropriation of property belonging to another with the intention of permanently depriving the other of it. All five elements — appropriation, property, belonging to another, dishonesty, and intention to permanently deprive — must be present. The case of R v Ghosh offers guidance on dishonesty, though the test has been refined by the Supreme Court in Ivey v Genting Casinos to an objective standard.

Robbery is laid down in section 8 of the Theft Act. It is theft that uses or threatens force on a person immediately before or at the time of the theft, and the force must be used in order to steal. The theft must be complete for a robbery conviction; if the theft element fails, the defendant cannot be convicted of robbery but may be guilty of assault or other offences.

Section 9(1)(b) covers the situation where a person enters as a trespasser and, once inside, commits or attempts to commit theft or GBH. The entry must be effective and the defendant must know, or be reckless as to, being a trespasser.

Self-defence is a full defence available to a person who uses reasonable force to protect themselves, another person, property, or to prevent a crime. The force must be necessary and proportionate in the circumstances as the defendant honestly believed them to be, even if that belief was mistaken. This common law defence is supplemented by section 76 of the Criminal Justice and Immigration Act 2008.

It is not a defence to crimes of basic intent, such as s.20 GBH or assault, because becoming voluntarily intoxicated is considered a reckless course of conduct. Involuntary intoxication, where the defendant did not knowingly consume the intoxicant, can be a defence to any crime if it negates mens rea.

Consent may operate as a defence to some non-fatal offences, particularly battery and, to a limited extent, ABH. A valid consent must be freely given and informed. Consent is not generally a defence to GBH or wounding, unless the activity falls within recognised exceptions such as properly conducted sporting contests, medical treatment, or ritual tattooing and piercing.

The tort of negligence imposes liability when a person breaches a duty of care owed to another, causing foreseeable damage. The modern framework was established in Donoghue v Stevenson, where Lord Atkin formulated the ‘neighbour principle’: you must take reasonable care to avoid acts or omissions that you can reasonably foresee would injure your neighbour — persons closely and directly affected by your conduct.

To succeed in a negligence claim, the claimant must prove: a duty of care existed, the defendant breached that duty, the breach caused the damage, and the damage was not too remote. The duty of care is often approached using the Caparo three-part test: foreseeability of harm, proximity between the parties, and whether imposing a duty is fair, just and reasonable.

Causation requires both factual causation (the ‘but for’ test) and legal causation (the damage must not be too remote). A claim will fail if the chain of causation is broken by a new intervening act.

A legally binding contract requires an offer, acceptance, consideration, and an intention to create legal relations. An offer is a clear statement of the terms on which the offeror is prepared to be bound. It must be distinguished from an invitation to treat, which is an invitation to negotiate (e.g., goods displayed on a shop shelf are generally invitations to treat, per Pharmaceutical Society of GB v Boots).

The mirror image rule requires that acceptance exactly matches the offer; a counter-offer destroys the original offer and proposes new terms.

Consideration is the price for which the promise of the other is bought. It must move from the promisee, need not be adequate but must be sufficient in law. Past consideration is generally not valid, and the performance of an existing public duty or contractual duty is not good consideration unless some extra benefit is provided. The doctrine of promissory estoppel, from Central London Property Trust v High Trees House, can sometimes prevent a party from going back on a promise even without fresh consideration.

In social and domestic arrangements, there is a presumption against an intention to create legal relations, though this too can be rebutted if evidence shows otherwise (as in Merritt v Merritt).

Parliament creates statute law through a formal legislative process. A Bill may start in either the House of Commons or the House of Lords and passes through several stages — first reading, second reading, committee stage, report stage, third reading — before receiving Royal Assent and becoming an Act. Green Papers and White Papers set out policy proposals and detailed plans for new legislation.

Any other remarks are obiter dicta, which may be persuasive but are not binding. The hierarchy of courts underpins the system: the Supreme Court binds all courts below, the Court of Appeal binds itself and lower courts, and the High Court binds all lower courts.

The purposive approach goes further, seeking to give effect to the overall purpose of the legislation, often influenced by European methods and human rights considerations.

The Human Rights Act 1998 incorporates the European Convention on Human Rights into UK domestic law. The Act does not allow courts to strike down primary legislation, but the higher courts can issue a declaration of incompatibility if a statute cannot be read compatibly with Convention rights. This signals to Parliament that the law should be amended, though Parliament retains sovereignty and is not forced to change it.

These rights are not absolute; some are qualified and can be restricted where necessary in a democratic society, provided any restriction is prescribed by law and proportionate.
