Law is not like mathematics — you will not find equations with x and y. But law does have its own “formulas”: principles, rules and maxims that help us understand how justice works. This handbook gives you a quick reference to the core legal formulas (principles) you need for KS3 WJEC Law. Use it to revise the building blocks of the legal system in England and Wales.

1. Actus Reus + Mens Rea = Crime | 犯罪行为 + 犯罪意图 = 犯罪

The most fundamental legal formula states that a crime is made up of two parts: the guilty act (actus reus) and the guilty mind (mens rea). To secure a conviction, the prosecution usually must prove both. If either element is missing, the accused is not guilty.

最基本的法律公式指出,犯罪由两部分组成:犯罪行为(actus reus)和犯罪意图(mens rea)。为了定罪,控方通常必须证明两者。如果缺少任何一个要素,被告即不构成犯罪。

Actus reus can be an action (like hitting someone), a failure to act when there is a duty (like a parent not feeding a child), or a state of affairs (like being found drunk in a public place). Mens rea refers to the mental element — for example, intention, recklessness or negligence.

2. The Burden of Proof: ‘Beyond Reasonable Doubt’ | 举证责任:“排除合理怀疑”

In criminal law, the prosecution bears the burden of proving the defendant’s guilt. This is the golden thread of English law: a person is presumed innocent until proven guilty. The standard of proof is ‘beyond reasonable doubt’ — the highest standard in law.

在刑法中,控方承担证明被告有罪的责任。这是英格兰法律的黄金原则:任何人在被证明有罪之前被推定无罪。证明标准是“排除合理怀疑”——法律上最高的标准。

If the jury or magistrates have any reasonable doubt about the defendant’s guilt, they must acquit. In civil cases, the standard is lower: ‘on the balance of probabilities’ (more likely than not). The formula for a criminal verdict is therefore: Prosecution proves all elements beyond reasonable doubt → Guilty; otherwise → Not Guilty.

3. The Rule of Law | 法治原则

The rule of law is a foundational principle in the UK constitution. It means that no one is above the law, and everyone is subject to the same legal rules. This principle acts as a formula to check the exercise of power by the state.

法治是英国宪法的根本原则。它意味着没有人凌驾于法律之上,每个人都受相同法律规则的约束。这一原则作为一个公式,用以制约国家权力的行使。

Key ingredients include: laws must be clear, published and stable; justice must be accessible; and the rights of individuals must be protected by independent courts. The rule of law can be summarised as:

4. Sources of Law: Statute + Precedent | 法律渊源:制定法 + 判例

In England and Wales, the two main sources of law are Acts of Parliament (statute law) and judicial precedent (case law). The formula for a legal rule often starts with a statute, which is then interpreted and applied by judges through the doctrine of precedent.

在英格兰和威尔士,两个主要的法律渊源是议会法案(制定法)和司法判例(判例法)。一项法律规则的公式通常始于制定法,然后由法官通过遵循先例原则对其进行解释和适用。

The hierarchy of courts is crucial: decisions of higher courts bind lower courts. The Supreme Court is the highest authority. Where a statute conflicts with a precedent, statute prevails because of parliamentary sovereignty. This can be expressed as:

5. Tort Law: Duty + Breach + Damage = Negligence | 侵权法:义务 + 违反 + 损害 = 过失

The tort of negligence is one of the most important civil wrongs. To succeed in a negligence claim, a claimant must prove three things: the defendant owed them a duty of care, the defendant breached that duty, and the breach caused damage which is not too remote. This is the classic formula from Donoghue v Stevenson.

过失侵权是最重要的民事不法行为之一。要成功主张过失,索赔人必须证明三件事:被告对其负有注意义务,被告违反了该义务,且该违反造成了非过于遥远的损害。这是源自 Donoghue v Stevenson 案的经典公式。

The duty of care is based on the ‘neighbour principle’: you must take reasonable care to avoid acts or omissions which you can reasonably foresee would be likely to injure your neighbour. A neighbour in law is anyone who is closely and directly affected by your actions.

6. Criminal Law Principles: Automatism and Intoxication | 刑法原则:自动症与醉酒

Sometimes a defendant may raise a defence that negates either the actus reus or mens rea. Two important legal principles are automatism and intoxication. Automatism is a complete defence because it shows the act was not voluntary. Intoxication, however, is a more limited defence — it depends on whether the offence is one of specific or basic intent.

有时被告可能提出抗辩,否定犯罪行为或犯罪意图。两个重要的法律原则是自动症和醉酒。自动症是一个完全抗辩,因为它表明该行为并非自愿。然而,醉酒是一个更受限制的抗辩——它取决于罪行是特定意图还是基本意图。

The formula for automatism: voluntary act missing → actus reus not established → not guilty. For intoxication, if it is voluntary intoxication and the crime is one of basic intent, the defendant may still be convicted if they would have formed the mens rea had they been sober. Specific intent crimes require proof of a higher level of intent, and intoxication may negate that.

7. Sentencing: Aggravating and Mitigating Factors | 量刑:加重与减轻因素

When a defendant is found guilty, judges use a sentencing formula that considers the harm caused and the culpability of the offender. Within this, aggravating factors increase the seriousness and mitigating factors reduce it. The final sentence is a balance of these plus any statutory guidelines.

当被告被判有罪时,法官使用量刑公式,考虑造成的损害和犯罪者的罪责程度。其中,加重因素增加严重性,减轻因素降低严重性。最终刑罚是这些因素的平衡,外加任何法定指南。

Examples of aggravating factors: offence committed while on bail, previous convictions, use of a weapon, vulnerable victim. Mitigating factors: no previous convictions, genuine remorse, minor role in the offence, provocation. A basic sentencing formula could be:

8. Parliamentary Supremacy and Delegated Legislation | 议会主权与授权立法

Parliament is the supreme law-making body. It can make or unmake any law, and no other body can override it. This principle, developed by A.V. Dicey, is a constitutional formula. However, Parliament often delegates law-making powers to government ministers and local authorities through ‘delegated legislation’.

议会是最高立法机关。它可以制定或废除任何法律,其他任何机构都不能推翻它。这一由 A.V. 戴雪发展的原则是一项宪法公式。然而,议会经常通过“授权立法”将立法权委托给政府部长和地方当局。

Delegated legislation comes in forms such as statutory instruments, bylaws and Orders in Council. It must stay within the powers granted by the parent Act, otherwise the courts can strike it down as ultra vires (beyond powers). The formula is:

Under the Human Rights Act 1998, public authorities must act compatibly with Convention rights. Many rights are qualified, meaning they can be restricted if certain conditions are met. The proportionality test is a legal formula used to decide if a restriction is justified. It asks: is the objective sufficiently important, is the measure rationally connected, is it no more than necessary, and is it a fair balance?

The four-stage test ensures individual rights are not infringed arbitrarily. For example, a ban on a protest may be proportionate if there is a serious threat of disorder, but not if a peaceful demonstration is merely inconvenient. Remember:

10. The Separation of Powers | 权力分立

The separation of powers is a model for how a state should be governed. It divides government into three branches: the legislature (makes law), the executive (implements law) and the judiciary (interprets law). This concept prevents an over-concentration of power and acts as a system of checks and balances.

权力分立是一个关于国家如何治理的模式。它将政府分为三个分支:立法机关(制定法律)、行政机关(实施法律)和司法机关(解释法律)。这一概念防止权力过度集中,并起到制衡系统的作用。

In the UK, the separation is not strict; for example, government ministers sit in Parliament. However, the Constitutional Reform Act 2005 strengthened judicial independence by creating the Supreme Court away from the House of Lords. The principle can be reduced to a formula:

11. Alternative Dispute Resolution: Negotiation → Mediation → Arbitration | 替代性争议解决:协商 → 调解 → 仲裁

Not all disputes go to court. The formula for resolving conflicts often starts with negotiation (parties talk directly), then mediation (a neutral third party helps them reach a solution) and finally arbitration (a third party makes a binding decision). These form the ‘ADR ladder’.

ADR is cheaper, faster and more private than litigation. However, it is not suitable for all cases — for example, where a legal precedent is needed or where there is a power imbalance between the parties. The stages are sequential but parties can jump to arbitration directly if they agree.
