The more serious offence under s.18 is wounding or causing GBH with intent (specific intent to cause GBH or resist arrest); it carries a maximum life sentence.

The test for dishonesty is now based on R v Ivey (as confirmed in R v Barton): first, ascertain the defendant’s actual state of knowledge or belief as to the facts; second, determine whether the conduct was dishonest by the standards of ordinary decent people. The defendant does not need to appreciate that their conduct was dishonest by those standards. The intention to permanently deprive includes treating the property as one’s own regardless of the owner’s rights (s.6), or borrowing causing outright exhaustion.

Robbery (s.8) is theft accompanied by force or threat of force immediately before or at the time of stealing. Remedies include rescission and/or damages. Mistake makes a contract void ab initio in cases of fundamental common mistake as to existence (Couturier v Hastie), or mutual/unilateral mistake as to identity where identity is vital (Lewis v Averay; Shogun Finance).
