3. Judicial Precedent | 司法先例

The doctrine of judicial precedent (stare decisis) ensures consistency and predictability in the common law. A court is bound by decisions of higher courts in the same hierarchy. The ratio decidendi (the legal reason for the decision) is binding, whereas obiter dicta (statements made ‘by the way’) are persuasive. The Supreme Court (formerly the House of Lords) binds all lower courts, and the Court of Appeal is bound by its own previous decisions subject to limited exceptions.

5. Legislative Process | 立法程序

A Bill must pass through several stages in both Houses of Parliament (Commons and Lords) before receiving Royal Assent and becoming an Act of Parliament. The House of Commons has primacy under the Parliament Acts 1911 and 1949, which allow a Bill to be passed without the Lords’ consent after a delay.

7. Negligence in Tort Law | 侵权法中的过失责任

The tort of negligence requires proof of duty of care, breach of that duty, and causation of damage. The modern test for duty of care stems from Caparo Industries plc v Dickman, requiring foreseeability of harm, proximity, and that it is fair, just, and reasonable to impose a duty. Breach is assessed by the standard of the reasonable person, factoring in likelihood of harm, seriousness of harm, cost of precautions, and social utility.

The postal rule provides an exception where acceptance is effective upon posting.

Some rights are absolute, while others are qualified and may be restricted in accordance with the law and in pursuit of a legitimate aim.

Methods of reform include consolidation, codification, and repeal of outdated laws.
