Actus Reus (Conduct + Circumstances + Consequences) + Mens Rea (Intention / Recklessness) + Absence of Defence → Criminal Liability

The fundamental building blocks of a crime can be expressed as a cumulative equation. Actus reus is the external element—conduct, circumstances, and any required consequence (e.g., death in murder). Mens rea is the mental element, typically intention or recklessness. Where a crime is one of strict liability, the mens rea requirement is partially or wholly displaced. A defendant may still escape liability if a complete defence, such as self-defence or insanity, applies.

In negligence, a duty of care must first be established using the tripartite test from Caparo v Dickman. The harm must be reasonably foreseeable; there must be a relationship of sufficient proximity between claimant and defendant; and the court must consider it fair, just and reasonable to impose a duty. While the test is applied generally, established duty situations (e.g., driver–road user) allow courts to infer a duty without detailed analysis.

Once a duty is established, breach is measured against the standard of the reasonable person. The court balances risk factors: the likelihood of harm, the seriousness of potential injury, the cost and practicality of precautions, and the social utility of the defendant’s activity (the ‘Learned Hand’ approach: weigh burden of precautions against probability × loss). Causation must follow the ‘but for’ and substantial cause tests. Even then, damage is only recoverable if the type of damage was a reasonably foreseeable consequence (The Wagon Mound).

Under the Occupiers’ Liability Act 1957, occupiers owe a ‘common duty of care’ to all lawful visitors: to take such care as is reasonable in all the circumstances to see that the visitor will be reasonably safe in using the premises. For trespassers, the 1984 Act imposes a duty only if three pre-conditions are satisfied: the occupier is aware of the danger or has reasonable grounds to believe it exists; knows or has reasonable grounds to believe a trespasser is in the vicinity or may come; and the risk is one against which the occupier may reasonably be expected to offer some protection. Break any link, and no duty arises.

A contract comes into existence when one party makes an offer, the other party unconditionally accepts it, valuable consideration (something of value) is exchanged, and both intend to create legal relations. An offer must be distinguished from an invitation to treat (e.g., goods on display). Acceptance must mirror the offer exactly—any variation is a counter-offer. The postal rule operates as an exception, making acceptance effective upon posting. In social and domestic arrangements, there is a presumption against legal intent, while commercial agreements carry a strong presumption in favour.

Unlawful Killing + Malice Aforethought (Intention to Kill / Cause GBH) – (Diminished Responsibility or Loss of Control) → Murder or Voluntary Manslaughter

Murder requires the unlawful killing of a reasonable person under the Queen’s peace with malice aforethought, which means an intention to kill or cause grievous bodily harm. If a partial defence succeeds, the conviction is reduced to voluntary manslaughter. Diminished responsibility (s.2 Homicide Act 1957, amended) requires an abnormality of mental functioning arising from a recognised medical condition that substantially impaired the defendant’s ability to understand, judge, or control their conduct. Loss of control (s.54 Coroners and Justice Act 2009) demands a loss of self-control with a qualifying trigger and a reaction that a person of the defendant’s sex and age with normal tolerance might have had.

The hierarchy of non-fatal offences against the person builds in severity. The table below captures the key actus reus and mens rea for each offence. Remember, for section 47 ABH, the mens rea is simply that of the underlying assault or battery—no intent or recklessness as to the actual bodily harm is required. For section 18 GBH, the prosecution must prove a specific intent to cause grievous bodily harm or to resist/prevent lawful arrest.

9. Statutory Interpretation Rules | 法律解释规则公式

Literal Rule → (If Ambiguous/Absurd) → Golden Rule → Mischief Rule / Purposive Approach

When judges interpret legislation, they deploy a hierarchy of approaches. The literal rule gives words their plain, ordinary meaning. If this leads to an absurd result, the golden rule allows a modified interpretation to avoid the absurdity. The mischief rule looks at the gap in the law that the statute aimed to fill, while the purposive approach (dominant in EU-derived and human rights contexts) seeks to give effect to the broader purpose of the legislation. In Pre-U essays, be ready to compare these rules through cases like Whitely v Chappell and Pepper v Hart.

The doctrine of stare decisis ensures consistency. The ratio decidendi—the legal reason necessary for the decision—binds lower courts in later similar cases. Obiter dicta, remarks made ‘by the way’, are not binding but may be highly persuasive. The court hierarchy dictates the flow of binding precedent: the Supreme Court binds all courts below (though it may depart from its own decisions under the 1966 Practice Statement); the Court of Appeal binds itself and lower courts; and the High Court binds inferior courts.
