1. Civil Law and Criminal Law Are the Same Sort of Case | 民法与刑法是同类案件
A common mistake is to treat civil and criminal cases as interchangeable. In reality they have different parties, purposes, courts and standards of proof. Criminal law is concerned with punishing the defendant on behalf of the state, while civil law usually resolves disputes between private parties, with the main remedy being damages or an injunction.

The literal rule starts with the ordinary dictionary meaning; the golden rule avoids absurdity; the mischief rule looks at the gap in the old law; the purposive approach gives effect to Parliament’s purpose.

A good motive does not automatically negative the mental element, and a bad motive does not by itself create liability.
