In a criminal scenario, look for the offence and the defence. Common issues include whether the defendant had the required mens rea, whether an act was voluntary, and whether a partial or full defence applies. Underline the facts that point to guilt or innocence.

When applying these elements, write sentences such as ‘The actus reus of theft is satisfied because Dan took Priya’s phone without consent. The mens rea is satisfied if he was dishonest and intended to keep it permanently.’

Self-defence can be a full defence to a non-fatal offence if the defendant honestly believed that force was necessary and the amount of force used was reasonable in the circumstances. In a problem question, discuss both the subjective belief and the objective reasonableness of the force.

Dan deliberately pushed Priya during the argument, so mens rea is likely satisfied.’

Do not simply retell the facts or write everything you know about a topic. Do not ignore the question’s command words. Do not forget to consider defences or alternative outcomes. A common error is stating a rule without applying it to the specific facts.

Another mistake is failing to use case names or statutory sections when stating the rule. CCEA examiners expect authority for legal principles. Practise writing concise case citations: ‘as in Donoghue v Stevenson’ or ‘under the Theft Act 1968’.

However, the force may be unreasonable because Liam was only shouting and had not attacked. Hitting Liam with a wooden stick could be disproportionate.

11. Exam Technique for CCEA | CCEA 考试技巧

Read the scenario twice. Highlight names, actions, injuries and any words suggesting intention or belief. Plan your answer for two minutes using IRAC. Allocate time according to marks: a five-mark question needs a shorter but still structured answer than a ten-mark question.
