IGCSE WJEC Law: Case Analysis in Action | IGCSE WJEC

📚 IGCSE WJEC Law: Case Analysis in Action | IGCSE WJEC

Case analysis is at the heart of the IGCSE WJEC Law assessment. This guide walks you through a repeatable, exam-ready method for turning case scenarios into structured legal arguments.

1. Why Case Analysis Matters |

In WJEC IGCSE Law, case analysis is not an optional skill. Most examination questions are built around short factual scenarios that require you to identify relevant law, apply it to the facts, and justify a conclusion.

Strong case analysis shows the examiner that you understand how legal rules operate in real disputes. It also helps you move from describing the law to using it, which is what higher-band answers do.

  • Identify actual legal questions. /
  • Apply sources accurately. /
  • Reach reasoned outcomes. /

2. Anatomy of a Law Exam Case Scenario |

A typical scenario includes the parties, key events, dates, and sometimes a phrase from a statute or previous case. You should read the scenario at least twice and underline the facts that create legal rights or duties.

Start by asking who the claimant or prosecutor is, what the defendant did or failed to do, and what remedy or punishment is being sought. These elements fix the legal context before you begin writing.

  • Remedy or penalty / 救济或惩罚:damages, injunction, fine, imprisonment.

3. IRAC: Your Core Method | IRAC:

IRAC stands for Issue, Rule, Application, Conclusion. It gives your answer a clear chain of reasoning, which WJEC mark schemes reward.

Step Question to answer
Issue What legal question must be decided?
Rule Which statute, test, or precedent applies?
Application How do the facts meet or fail the rule?
Conclusion What is the likely legal outcome?

Use IRAC for every scenario, whether it is criminal, contract, tort, or a statutory problem. Consistency in structure is more important than creative legal writing at this level.

4. Issue: Spotting Legal Questions |

Frame each issue as a precise question, such as ‘Has Alex committed criminal damage under s.1 Criminal Damage Act 1971?’ Avoid vague statements such as ‘Alex has broken the law.’

Look for clues in the scenario: a person may face both civil and criminal liability, and a single event may raise more than one issue. List them separately before you begin the rule section.

  • Has a duty of care been breached? /
  • Is there a valid contract term? /
  • Does a defence apply? /
  • Does the act meet the statutory wording? /

5. Rule: Stating Principles and Precedent |

State the rule before applying facts. Mention the source, for example ‘the neighbour principle in Donoghue v Stevenson [1932] AC 562 requires a person to take reasonable care to avoid acts or omissions likely to injure a neighbour.’

For statutory rules, quote or paraphrase the key wording accurately. If you use a case, show what part of the judgment supplies the binding legal principle.

Criminal Damage Act 1971, Theft Act 1968, Human Rights Act 1998.
  • Case law / 判例法:Donoghue v Stevenson, Fagan v MPC, Fisher v Bell.
  • Legal tests / 法律标准:neighbour principle, reasonable person, mens rea.

6. Application: Linking Facts to Law |

This is where most marks are won or lost. Do not simply repeat the law; show why the law applies to this particular defendant, victim, act, or omission.

Use connective phrases such as ‘because’, ‘since’, and ‘on the facts’ to embed the scenario into your legal reasoning. If a fact is missing, say what additional fact would change your answer.

For example, if a defendant threw a stone at a car, do not just state that criminal damage requires intention or recklessness. Explain that aiming at the car strongly suggests intention to damage, or at least recklessness as to damage.

7. Conclusion: Reaching a Defensible Outcome |

Your conclusion must follow from your application. It should state the likely outcome, such as ‘liable’ or ‘not guilty’, and briefly explain the main reason.

Do not introduce new law in the conclusion. A strong conclusion is short, confident, and linked directly to the strongest element of your application.

  • Criminal: ‘A court is likely to convict because the actus reus and mens rea coincide.’ /
  • Civil: ‘The defendant is likely to be liable in negligence because breach and damage are established.’ /

8. Criminal vs Civil Case Analysis |

Criminal scenarios require proof beyond reasonable doubt and focus on actus reus, mens rea, and defences. Civil scenarios usually require proof on the balance of probabilities and focus on liability for negligence, contract, or tort.

Feature Criminal Civil
Burden of proof Beyond reasonable doubt Balance of probabilities
Parties Prosecution v Defendant Claimant v Defendant
Key elements Actus reus, mens rea, defences Duty, breach, causation, damage
Outcome Conviction or acquittal Liable or not liable

When a scenario is mixed, make a short paragraph for the criminal side and another for the civil side. Never treat criminal and civil issues as the same question.

9. Using Precedent Effectively |

Distinguish binding precedent from persuasive precedent. Ratio decidendi binds lower courts, while obiter dicta may guide future cases but is not strictly binding.

You can strengthen an answer by showing how a case is similar to the scenario or how it can be distinguished. For example, consent may be a defence to minor harm in one case but not to serious harm in another.

  • Follow / 遵循:facts fall within the ratio of a higher court.
  • Distinguish / 区别:material facts are different from the precedent.
  • Overrule / 推翻:a higher court changes the legal principle.

10. Statutory Interpretation in Practice |

When a scenario turns on the meaning of a word in a statute, use the rules of interpretation: literal rule, golden rule, mischief rule, and purposive approach.

Fisher v Bell [1961] 1 QB 394 is a classic example of the literal rule. A shopkeeper displaying a flick knife was not ‘offering for sale’ because in contract law a display is only an invitation to treat.

Fisher v Bell [1961] 1 QB 394

In an exam, show which rule you are using and explain why it leads to a fair or unfair result. The purposive approach is often used for modern statutes that protect public safety.

11. Common Pitfalls and How to Avoid Them | 常见失分点与避免方法

Most avoidable errors come from rushing into an answer without a plan. Take a few minutes to identify the issues and note the rule for each one.

  • Narrative answers: do not retell the story. /
  • Missing defences: always check self-defence, consent, duress, or lawful excuse. /
  • No authority: cite a statute or case for every rule. /
  • Ignoring causation: link the breach to the damage in civil questions. /
  • One-sided analysis: consider both sides where the law is uncertain. /
