The Supreme Court of the United Kingdom is the highest court in the country for most civil and criminal cases. It was established by the Constitutional Reform Act 2005 and began sitting in 2009, taking over the judicial role of the House of Lords. Its main functions are to interpret the law, hear appeals on points of law of public importance, and ensure that public authorities act within their legal powers.

The Supreme Court is the final court of appeal in the UK for civil cases, and for criminal cases from England, Wales and Northern Ireland. Scottish criminal cases are generally finally decided by the High Court of Justiciary in Scotland, except where devolution or human rights issues are raised.

Under the Human Rights Act 1998, UK courts can interpret legislation to be compatible with the European Convention on Human Rights where possible. If a higher court finds that primary legislation is incompatible, it can issue a declaration of incompatibility under section 4.

A declaration of incompatibility does not invalidate the Act of Parliament. Parliamentary sovereignty is a fundamental principle of the UK constitution. It means Parliament can make or unmake any law, and no court can override primary legislation. The Supreme Court recognises this principle and cannot declare an Act of Parliament unconstitutional.
