📚 The Powers, Strengths and Weaknesses of Each of the Houses |

In Edexcel A-Level Politics, the UK Parliament is a bicameral legislature. The House of Commons and the House of Lords have different powers, strengths and weaknesses. Examiners often ask students to compare these two chambers and evaluate how effectively they perform their functions.

1. The Two Houses at a Glance |

The House of Commons is the elected lower chamber with 650 Members of Parliament (MPs), each representing a single-member constituency under the first-past-the-post system. It is the primary legislative and financial chamber.

The House of Lords is the unelected upper chamber with around 800 members, including life peers, hereditary peers and bishops. It acts mainly as a revising and scrutinising chamber.

2. Core Powers of the House of Commons |

The Commons holds primary legislative authority. Most government bills are introduced and debated there, and the Commons can amend or reject legislation. It also has exclusive control over money bills and financial matters, known as financial privilege.

The Commons can hold the government to account through Prime Minister’s Questions, ministerial questions, urgent questions, select committees and votes of no confidence. A government that loses a confidence vote must resign or call a general election.

3. Strengths of the House of Commons |

The Commons has strong democratic legitimacy because MPs are directly elected. This gives the chamber the moral and constitutional authority to make laws and impose taxation on behalf of the people.

Party discipline, enforced by whips, usually ensures that the government can pass its programme. This produces stable and predictable government, especially when one party has a clear majority.

4. Weaknesses of the House of Commons |

The Commons is often dominated by the executive. A large government majority and strong party whips can reduce MPs to lobby fodder, weakening the chamber’s ability to scrutinise legislation independently.

Another weakness is that the first-past-the-post electoral system can produce a government with a majority of seats but a minority of votes. This raises concerns about representation and fairness.

5. Core Powers of the House of Lords |

The Lords can scrutinise, amend and delay legislation. It cannot veto bills permanently, but it can require the Commons to reconsider decisions and can delay non-money bills for up to one year under the Parliament Acts.

The Lords also reviews secondary legislation, conducts detailed committee investigations and contributes to public debate on constitutional and ethical issues.

6. Strengths of the House of Lords |

One major strength is expertise. Many peers are former ministers, judges, scientists, business leaders and academics. This allows the Lords to offer highly informed scrutiny that the Commons often lacks.

Peers are less bound by party whips and do not face re-election. This independence enables them to review legislation on its merits, defend civil liberties and protect minority interests without fear of losing their seats.

7. Weaknesses of the House of Lords |

The Lords lacks democratic legitimacy because no member is elected. This weakens its authority to challenge the elected Commons and makes it vulnerable to criticism that it is an undemocratic relic.

The chamber is also too large, with around 800 members, and its composition is controversial. The continued presence of hereditary peers and the role of prime ministerial patronage in appointing life peers raise questions about fairness and accountability.

8. The Parliament Acts and the Balance of Power |

The Parliament Acts of 1911 and 1949 removed the Lords’ absolute veto over legislation. Money bills can only be delayed for one month, and other public bills can be delayed for up to one year. After that, the Commons can pass them without the Lords’ consent.

The Salisbury Convention also prevents the Lords from blocking legislation that implements a government’s manifesto commitments. This convention preserves the primacy of the elected Commons while retaining the Lords’ revising role.

9. Comparing the Commons and Lords |

The table summarises the key differences in power, strengths and weaknesses between the two chambers.

Feature House of Commons House of Lords
Legitimacy High, directly elected Low, unelected
Main power Legislate, tax, hold government to account Revise and delay legislation
Key strength Democratic mandate, stable government Expertise, independence
Key weakness Executive dominance, party control Democratic deficit, limited power

The table shows that the two chambers are complementary rather than equal. The Commons supplies democratic authority, while the Lords supplies scrutiny and restraint.

10. Reform Debates |

Reform of the House of Lords is a recurring issue. Options include a fully elected chamber, a partly elected chamber, appointment by an independent commission, or abolition. Each proposal involves trade-offs between democratic legitimacy and independent expertise.

Some also argue for reforming the Commons, for example by introducing proportional representation, strengthening select committees or giving MPs greater control over the parliamentary timetable.

11. Exam Technique: Evaluating the Two Houses |

In a 30-mark Edexcel question, avoid simply listing powers. Use criteria such as democratic legitimacy, accountability, legislative effectiveness and independence. Compare both chambers and reach a justified judgement.

For example, you might argue that the Commons is more powerful but the Lords is often more effective at detailed scrutiny. A balanced conclusion should recognise the value of both chambers in the UK constitutional system.

12. Key Terms and Conclusion |

Key terms include bicameralism, financial privilege, the Salisbury Convention, the Parliament Acts, democratic legitimacy, accountability, scrutiny and reform.

The House of Commons provides democratic legitimacy and governing power, but it is often dominated by the executive. The House of Lords lacks democratic authority but adds expertise, independence and careful revision. Together they form a system of checks and balances within Parliament, although both face significant criticisms and calls for reform.
