A legal case is a dispute between two or more parties that is brought to a court for a decision. Cases can involve criminal matters, like theft, or civil matters, like someone breaking a promise or damaging property. By studying cases, we learn how judges apply the law to real situations and how legal principles are developed.

Analysing cases helps us understand legal principles and develop critical thinking. It shows us that law is not just a set of rules, but a tool for solving real problems. For Year 7 students, case analysis builds skills in reasoning, argument and logical writing – all essential for law and many other subjects.

3. The Four-Step Method | 案例分析的四步法

We will use a simple four‐step method known as FIRC: Facts, Issue, Rule, and Conclusion. First, identify the Facts (what happened). Second, state the Issue (the legal question). Third, find the Rule (the law or principle that applies). Fourth, reach a Conclusion by applying the rule to the facts. This is like a recipe for solving legal puzzles.

Avoid phrases like ‘Is it fair?’ and stick to whether a legal duty exists or has been broken.

For example, ‘If you borrow something, you must return it in the same condition. If you damage or lose it, you must make it right.’ Always state the rule clearly before applying it.

Application means matching the facts to the rule. You ask: do the facts fit the rule? Then you reach a conclusion. For instance, ‘Anna borrowed Ben’s pencil and lost it. The rule says you must return borrowed items or compensate for loss. Therefore, Anna must give Ben a new pencil or pay for it.’ This step turns legal theory into a real result.

You have a duty to take reasonable care not to harm others. Playing football near windows requires extra care. Application: Carlos was in control of the ball; his action directly caused the damage. He knew or should have known that kicking hard near a building could break glass. The facts fit the rule.

What if the school had no rule banning football in that area?

What are the facts, issue, rule, application, and conclusion? Write down each step and then compare with a partner.
