When he arrived home, he realised the phone had Aisha’s photos and data. He immediately returned it to the park keeper. Has Ben committed theft?

To answer, we look at the actus reus of theft: appropriation of property belonging to another. Ben did appropriate the phone by taking it. But did he have mens rea? Theft requires the intention to permanently deprive the owner of the property. At the time of taking, Ben honestly believed the phone was his own. This mistake means he lacked the guilty mind. Therefore, he would not be guilty of theft.

Always separate the physical act from the mental state in your analysis. Ask: ‘What exactly did the person do?’ and then ‘What was going on in their mind at that moment?’ For instance, if someone pushes another person causing them to fall, the actus reus of assault might be present. But if it was an accidental trip, the mens rea for intentional assault is missing, although other charges could apply.

5. The School Window Incident | 学校窗户事件
Scenario: During break time, Leo threw a stone across the playground, not aiming at anything in particular. The stone struck a classroom window, shattering it. The window was expensive to repair. Can Leo be charged with vandalism?

Vandalism requires either intention to destroy or damage property, or recklessness as to whether such damage is caused. Here, Leo did not intend to break the window. However, by throwing a stone in a playground near buildings, he was reckless. A reasonable person would realise that damage could occur. Recklessness is a form of mens rea recognised by the law. Therefore, Leo could be found guilty of vandalism due to his reckless behaviour.

Some offences do not require mens rea. These are called strict liability offences. For instance, selling food past its use-by date is an offence even if the shopkeeper did not know it was expired. The law focuses on the actus reus alone to protect public health and safety.

Now we switch to a civil law problem. Scenario: Mrs Green slipped on a wet floor in the fruit aisle of a supermarket. There was no warning sign. She broke her wrist and missed three weeks of work. She wants to claim compensation. Apply the law of negligence.

Therefore, she has a strong claim in negligence.

When examining any negligence problem, first establish who owed a duty to whom. The neighbour principle states that you must take reasonable care to avoid acts or omissions that you can foresee would be likely to injure your neighbour. Then assess whether the defendant’s conduct fell below the standard of a reasonable person.

In an exam, you may be asked to ‘advise’ a client or to ‘discuss’ liability. Your answer should follow a clear structure: state the issue, explain the relevant law, apply that law to the facts, and reach a conclusion. This is known as the IRAC method (Issue, Rule, Application, Conclusion).

The conclusion: the supermarket is probably liable. Practise writing short IRAC paragraphs.

Your conclusion should directly answer the question posed. Use phrases like ‘It is likely that…’ or ‘The court would probably find…’ because in law there is rarely absolute certainty. Always support your conclusion with reasons grounded in the legal elements you have analysed.

Remember not to introduce new facts or arguments in the conclusion. It should be a logical summary of the analysis you have already carried out. For instance, ‘Leo is likely to be found guilty of vandalism because his recklessness satisfies the mens rea requirement, even though he did not intend the specific damage.’
