1. The Sovereignty Formula: Crown-in-Parliament | 主权公式:君临议会

Parliamentary Sovereignty = Monarch + House of Commons + House of Lords → Valid Law

The UK Parliament is the supreme legal authority; no other body can override or set aside its legislation. The formula ‘Crown-in-Parliament’ captures the idea that a law needs the agreement of the Monarch (Royal Assent), the elected House of Commons, and the appointed House of Lords.

International treaties and EU law only have effect in the UK because Parliament has enacted them. Since Brexit, Parliament has reclaimed full sovereignty and can change any retained EU law.

Democracy = Free and Fair Elections + Political Participation + Accountable Government

Rule of Law = Equality Before Law + Independent Courts + Legal Certainty

No one – not even the Prime Minister, police officers, or government departments – is above the law. All individuals and public bodies are subject to the same legal rules.

Courts must be independent of political pressure; judges are appointed on merit and enjoy security of tenure so they can decide cases impartially.

Separation = Legislature (Parliament) + Executive (Government) + Judiciary (Courts)

The legislature (Parliament) makes law, the executive (Prime Minister and Cabinet) implements law and runs the country, and the judiciary (courts) interprets law and resolves disputes.

立法机关(议会)制定法律,行政机关(首相和内阁)执行法律并管理国家,而司法机关(法院)解释法律并解决争端。

In the UK, the separation is partial: government ministers are drawn from Parliament, so the executive sits inside the legislature. This fusion can lead to strong government, but requires robust checks.

Bill → First Reading → Second Reading → Committee Stage → Report Stage → Third Reading → Other House → Royal Assent → Act of Parliament

A government proposal begins as a Bill. First Reading is a formality where the title is read; no debate takes place. Second Reading is the main debate on the Bill’s principles, after which MPs vote.

At Committee Stage a small group of MPs examines the Bill clause by clause, suggesting amendments. Report Stage then allows the whole House to consider those amendments.

Once both Houses agree on the final text, the Monarch grants Royal Assent – a formal approval – and the Bill becomes an Act of Parliament, enforced as law.

Public Bills change the general law and affect the whole population; Private Bills affect specific organisations or localities. Private Members’ Bills are introduced by backbench MPs.

Independent Judiciary = Security of Tenure + Appointment on Merit + Separation from Politics

Judges in the UK cannot be dismissed by the government simply because it dislikes their decisions. They hold office during good behaviour, protected by constitutional convention and statute.
