2. The IRAC Method | IRAC方法

The IRAC method is the most common framework for case analysis. IRAC stands for Issue, Rule, Application, and Conclusion. This step-by-step approach keeps your thinking organised and your argument clear.

3. Step 1: Identify the Issue | 第一步:识别争议点

The first step is to read the scenario carefully and find the conflict between people or groups. Ask yourself: What exactly is being disputed? Who wants what? The issue should be phrased as a question, for example, ‘Is Alex liable for the damage to Beth’s car?’

4. Step 2: State the Rule | 第二步:陈述法律规则

Once you know the issue, find the relevant legal rule. Rules come from statutes (laws passed by Parliament) or from previous court decisions (common law). In Scotland, our legal system also uses principles of delict (civil wrongs) and contract law.

Use phrases like ‘In this case, Alex did not check his mirror before reversing, which shows he failed to take reasonable care.’

The conclusion answers the issue question. It tells the reader who wins and what remedy or penalty may follow. The conclusion must follow logically from your application.

In our earlier example: ‘Therefore, Alex is likely liable for the cost of repairing Beth’s car because he breached his duty of care.’

7. Example Case 1: The Noisy Neighbour | 案例一:吵闹的邻居

Scenario: Jamie lives in a Glasgow flat. Every night, his neighbour, Sam, plays loud music until 2 a.m. Jamie cannot sleep and feels stressed. Jamie complains, but Sam says, ‘It’s my flat, I can do what I want.’ The local council has a noise nuisance by-law that prohibits unreasonable noise after 11 p.m.

Application: Aisha borrowed the phone and had a duty to take reasonable care of it. Dropping a phone is often seen as careless unless there were unexpected circumstances. Aisha’s failure to hold it securely may be seen as negligent.

Rule: The Consumer Rights Act 2015 (which also applies to private sales in certain ways) says goods must be as described. Even in private sales, a seller must not misrepresent the condition.
