In law, the ability to analyse a case is as important as knowing the rules. This article provides hands-on exercises to practise the essential skill of case analysis within the AQA Law framework.

2. The IRAC Method | IRAC方法

One of the most popular tools for analysing a case is the IRAC method, which stands for Issue, Rule, Application, and Conclusion. This framework ensures that you cover all essential parts of legal reasoning in a structured way.

分析案例最流行的工具之一是IRAC方法,它代表问题(Issue)、规则(Rule)、应用(Application)和结论(Conclusion)。这个框架确保你以结构化的方式涵盖法律推理的所有必要部分。

Step Description
I – Issue Identify the legal question that needs to be answered.
R – Rule State the relevant law, statute or precedent that applies.
A – Application Explain how the rule applies to the facts of the case.
C – Conclusion Give a clear answer to the issue, based on your analysis.

IRAC的每个步骤:问题(Issue)是找出案件中必须解决的法律争议;规则(Rule)是查阅相关的法律条文或判例;应用(Application)是将法律规则与具体案情结合,分析法律是否被遵守或违反;结论(Conclusion)是给出最终答案。


3. Warm-up: A Simple Scenario | 热身:一个简单场景

Let’s start with a straightforward dispute. James asked Mia to look after his dog for a weekend, promising to pay her £20. Mia agreed and took care of the dog. Afterwards, James only handed her £10, saying she spent too much time on her phone. Mia feels this is unfair and wants the remaining £10. Can she claim it?

4. Identifying Facts and Legal Issues | 识别事实与法律问题

In case analysis, the first step is to sort the relevant facts from irrelevant ones. Key facts here are: an offer of £20 for dog-sitting, Mia’s acceptance, her performance of the task, and James’s partial payment. The legal issue is whether a valid contract was formed and, if so, whether James breached it by not paying the full amount.

在案例分析中,第一步是筛选相关事实与无关事实。这里的关键事实是:以20英镑照看狗的要约、米娅的接受、她完成了任务、以及詹姆斯的部分付款。法律问题是:是否形成了有效合同,如果是,詹姆斯未付全款是否构成违约。

5. Finding the Relevant Legal Rules | 查找相关法律规则

To resolve this dispute, we need rules from contract law. In England and Wales, a simple contract requires an offer, acceptance, and consideration (something of value exchanged). In this case, the offer was made (to pay £20 for a service), accepted (Mia said yes), and consideration exists (Mia’s work and the promised money). The law states that once these elements are met, a binding contract is formed.

要解决这一纠纷,我们需要合同法中的规则。在英格兰和威尔士,一个简单的合同需要要约、承诺和对价(交换的有价值之物)。在本案中,要约已作出(付20英镑换取服务),承诺已作出(米娅同意),对价也存在(米娅的劳动和答应的钱)。法律规定,一旦满足这些要素,就形成了有约束力的合同。

Furthermore, if one party fails to perform their part of the contract without a valid reason, they are in breach. The innocent party can claim damages to put them in the position they would have been in if the contract had been performed.

6. Applying the Law to the Facts | 将法律应用于事实

Now we apply these rules. Did James make an offer? Yes – ‘I will pay you £20 to dog-sit’. Did Mia accept? Yes – she agreed and performed the service. Was there consideration? Yes – each party received a benefit. So a contract existed. James’s failure to pay the full £20 is a breach. His reason about phone use is irrelevant because it was not part of the agreement. Therefore, Mia has a strong legal claim for the remaining £10
