1. What is Law? |

Law is a set of rules created by the state that governs the behaviour of individuals and organisations. Unlike moral or social rules, laws are enforceable through the courts, and breaking them can result in sanctions such as fines or imprisonment. The legal system provides a framework for resolving disputes and maintaining order in society.

Legal rules are formally recorded and apply equally to all citizens. They are designed to be clear, predictable, and accessible so that everyone knows what is expected of them. This principle, known as the rule of law, ensures that no one is above the law, including the government.

2. Why Do We Need Laws? |

Laws protect people’s safety and rights. They prevent harmful actions, such as theft, violence, and fraud, and provide a way to resolve conflicts peacefully. Without laws, society would be chaotic and unfair, as individuals might take justice into their own hands.

Laws also promote social justice by ensuring that everyone is treated equally and that vulnerable groups receive protection. They establish standards for business, education, and healthcare, creating a stable environment in which communities can thrive.

3. The UK Legal System |

The United Kingdom has a unique legal system that has evolved over centuries. It is a common law system, which means that many legal principles have been developed by judges through decisions in individual cases, rather than simply being written down in a single code.

The UK does not have a single legal system: England and Wales share one system, while Scotland and Northern Ireland have their own distinct legal traditions. In this syllabus, we focus on the law of England and Wales, which is the most common reference for AQA specifications.

4. Sources of Law: Parliament and Common Law |

The two main sources of law in England and Wales are statute law (laws passed by Parliament) and common law (laws developed by court decisions). Parliament is sovereign, meaning it can make or repeal any law, and its Acts are the highest form of law.

Common law, also known as case law or judge-made law, fills gaps where no statute exists. Judges interpret legislation and set binding precedents for lower courts. This principle of stare decisis (standing by previous decisions) ensures consistency and fairness in the legal system.

5. Criminal Law vs Civil Law |

Criminal law deals with offences against the state or society, such as murder, theft, and assault. The state prosecutes the defendant, and if found guilty, the offender can be punished by imprisonment, a fine, or community service. The standard of proof is ‘beyond reasonable doubt’.

Civil law resolves disputes between individuals or organisations, such as contract disputes, negligence claims, and family matters. The person bringing the case (the claimant) seeks compensation or an injunction, not punishment. The standard of proof is lower, based on ‘the balance of probabilities’.

Feature Criminal Law Civil Law
Purpose Punish offenders Resolve disputes, compensate
Parties State (prosecutor) vs Defendant Claimant vs Defendant
Outcome Guilty or Not Guilty Liable or Not Liable

6. The Role of the Police |

The police are responsible for maintaining public order, preventing crime, and investigating offences. When a crime is reported, the police gather evidence, question suspects, and make arrests where necessary. They must follow strict procedures under the Police and Criminal Evidence Act 1984 (PACE) to protect individual rights.

Police officers have the power to stop and search individuals if they have reasonable grounds. They can also detain suspects for up to 24 hours (extended for serious crimes) before charging or releasing them. The Crown Prosecution Service (CPS) then decides if there is enough evidence to prosecute.

7. The Court Structure |

The court system in England and Wales is hierarchical, with lower courts handling less serious cases and higher courts dealing with appeals and complex matters. At the lowest level, Magistrates’ Courts handle minor criminal cases (summary offences) and some civil matters. The Crown Court deals with serious criminal cases (indictable offences) tried by a judge and jury.

For civil cases, the County Court handles most claims of lower value, while the High Court deals with larger and more complex disputes. Above both criminal and civil courts, the Court of Appeal hears appeals, and the Supreme Court is the final court of appeal for all cases in the UK.

Magistrates’ Court → Crown Court → Court of Appeal (Criminal Division) → Supreme Court

8. The Jury System |

A jury is a group of 12 randomly selected members of the public who listen to the evidence in a Crown Court trial and decide whether the defendant is guilty. The jury’s verdict must be unanimous or, in some cases, a majority verdict (10–2) may be accepted. This system allows ordinary citizens to participate in the justice process.

Juries are essential for ensuring that the legal system reflects community values. However, jurors must not have any connection to the case and must base their decision solely on the evidence presented in court. Serving on a jury is a civic duty, and most adults aged 18–75 can be summoned.

9. Youth Justice |

Young people aged 10 to 17 are treated differently under the law in England and Wales. The age of criminal responsibility is 10, meaning children under 10 cannot be charged with a criminal offence. Those aged 10–17 are usually dealt with in the Youth Court, a specialist branch of the Magistrates’ Court, which focuses on rehabilitation rather than punishment.

Sentences for young offenders include referral orders, youth rehabilitation orders, and detention in severe cases. The Youth Justice Board oversees the system and works to prevent youth crime. The emphasis is on education and support to help young people avoid re-offending.

10. Human Rights and the Law |

Human rights are basic rights and freedoms that belong to every person. In the UK, the Human Rights Act 1998 incorporated the European Convention on Human Rights into domestic law. This means that individuals can bring human rights claims in UK courts without going to the European Court of Human Rights in Strasbourg.

Key rights include the right to life, freedom from torture, the right to a fair trial, and respect for private and family life. Public authorities must act in a way that is compatible with these rights, though they can be limited in certain circumstances, such as national security or public safety.

Understanding human rights is fundamental to studying law, as they underpin many legal principles and help protect individuals against abuse of power by the state.
