If the court believes him, he might lack dishonesty. However, keeping a modern bike without trying to find the owner could be seen as dishonest. Conclusion: Tom is likely guilty because a reasonable person would not assume a bike outside a shop is abandoned.

Conclusion: Eva is likely committing a nuisance and could be ordered to reduce noise or pay compensation.
