1. Understanding Case Analysis |

Case analysis is the process of examining a legal dispute to identify the material facts, the legal issues, the applicable rules and the likely outcome. It is a fundamental skill used daily by lawyers, judges and law students. In AQA Law exams, you will be expected to apply this process to both real and fictional scenarios, showing that you can think like a lawyer.

The purpose of case analysis is not simply to guess who wins, but to reason through the legal principles. You must look beyond the surface and ask questions such as: ‘What duty was owed?’, ‘Was the behaviour reasonable?’ and ‘Is there a direct link between the act and the harm?’ These questions form the backbone of legal enquiry.

2. Key Legal Concepts for Case Analysis |

Before diving into case analysis, you must be familiar with several key legal concepts. For Year 9, these include the distinction between civil and criminal law, the structure of the courts, and basic principles of tort and contract law. In particular, the elements of negligence – duty of care, breach of duty, causation and damage – form the backbone of many case studies. You will also need to understand the concept of precedent and how judges use earlier decisions to guide their rulings.

Civil Law Criminal Law
Disputes between individuals or organisations Offences against the state
Burden of proof on the balance of probabilities Burden of proof beyond reasonable doubt
Remedy usually damages or injunction Sanction may be imprisonment or fine

This table summarises the key differences you must keep in mind when classifying a case.

3. The IRAC Method | IRAC 方法

One of the most widely used frameworks for case analysis is IRAC: Issue, Rule, Application and Conclusion. This method provides a clear, structured way to answer law problem questions and is highly recommended for Year 9 students. It ensures you do not miss any vital step.

1. Issue: Identify the precise legal question that needs to be answered. For example, ‘Is X liable in negligence for the injuries suffered by Y?’ Always state the area of law and the specific dispute.

2. Rule: State the relevant legal principles, including statutory rules or case law. For negligence, cite Donoghue v Stevenson and the three-part test from Caparo. Define the legal standard, such as the ‘reasonable person’.

3. Application: Apply the rule to the facts of the case. This is the most important part. Link each legal element to a specific piece of evidence. Discuss both sides to show analytical depth.

4. Conclusion: Reach a reasoned outcome. Your conclusion must follow logically from your application. Use phrases like ‘Therefore, it is likely that…’ or ‘On balance, the court would probably find…’.

4. Identifying Legal Issues |

The first step in case analysis is to pinpoint the legal issues. Ask yourself: ‘What area of law is involved? Is there a potential breach of duty? Was a contract formed? Did the defendant owe a duty to the claimant?’ Focus on the factual trigger points that raise legal questions. Avoid getting distracted by irrelevant details.

Consider a simple scenario: Tom kicks a football carelessly and it smashes a neighbour’s greenhouse. Immediately, several legal issues may arise – trespass to land, nuisance, or even negligence if the neighbour was nearby and could have been injured. Learning to spot these issues is the hallmark of a good lawyer.

5. Applying Legal Rules |

Once you have identified the issues, you must state the relevant legal rules. For negligence, this includes the ‘neighbour principle’ from Donoghue v Stevenson, the duty of care, and the standard of the ‘reasonable person’. You should also know the Caparo v Dickman three-stage test: foreseeability of damage, proximity, and whether it is fair, just and reasonable to impose a duty.

The ‘but for’ test is central to causation: ‘but for the defendant’s breach, would the claimant have suffered the harm?’ If the answer is no, causation is established. Remember to use precise legal language and always link the rule back to a recognised authority.

6. Analysing Precedent |

Precedent is the lifeblood of the common law system. When analysing a case, you must consider whether the facts are sufficiently similar to an existing precedent. The doctrine of stare decisis means that a court is generally bound by decisions of higher courts. However, judges can distinguish a case on its material facts if they are genuinely different.

For example, in McLoughlin v O’Brian the court extended the duty of care to a mother who suffered nervous shock after seeing her family injured in an accident. The precedent was applied because she was closely tied to the immediate victims. Later cases tried to limit this by distinguishing the degree of proximity.

7. Distinguishing Cases |

Distinguishing is a technique used to avoid following an otherwise binding precedent. It involves showing that the material facts of the current case are different from those in the precedent, so the legal rule from that case does not apply. This is not about minor differences; the distinction must be legally significant.

Imagine a precedent where a driver caused an accident on a public motorway. If our case involves a go-kart on private land, a court might distinguish it because the nature of the location and the type of vehicle change the expected standard of care. Learning to argue both sides of a distinction is a crucial skill.

8. Constructing a Legal Argument |

A strong legal argument presents both sides, applies law to facts, and uses reasoning to justify the conclusion. You must always address counter-arguments to demonstrate a balanced analysis. Use phrases like ‘On the one hand … on the other hand …’ and ‘It could be argued that the defendant did not owe a duty because …’.

For instance, when arguing whether a school owes a duty of care to a student injured in the playground, you would point out that schools have a well-established duty, but also consider whether the injury resulted from normal rough play that no reasonable supervisor could have prevented. Always weigh the strengths and weaknesses.

9. Real-World Case Example: Donoghue v Stevenson | 真实案例示例:Donoghue v Stevenson

This landmark 1932 case established the modern law of negligence. Mrs Donoghue drank a bottle of ginger beer manufactured by Stevenson. The opaque bottle contained the decomposed remains of a snail. She fell ill and sued the manufacturer. The House of Lords held that a manufacturer owes a duty of care to the ultimate consumer, even without a contractual relationship. Lord Atkin’s ‘neighbour principle’ became the foundation of negligence.

Using IRAC: Issue – Does a manufacturer owe a duty of care to a consumer who is not in a contractual relationship? Rule – The neighbour principle: you must take reasonable care to avoid acts or omissions which you can reasonably foresee would be likely to injure your neighbour. Application – The manufacturer knew the product would reach the consumer without intermediate inspection; injury was foreseeable. Conclusion – A duty of care was owed, and Mrs Donoghue succeeded.

10. Practice Exercise: A Negligence Scenario |

Now it is your turn to practise. Read the following scenario carefully and apply the IRAC method.

Scenario: Lucy is shopping in a busy supermarket. She slips on a puddle of spilled milk that has been on the floor for over an hour. The store had no warning sign and no cleaner was nearby. Lucy twists her ankle severely and requires medical treatment. Analyse whether the supermarket is liable in negligence.

Begin by listing the issues: Is there a duty of care? Was that duty breached? Did the breach cause the harm? Are there any defences? Then research the rules: occupiers’ liability or common law negligence. Apply the facts – the milk was there for a long time, so a reasonable store should have cleaned it or warned customers. Conclude with a reasoned prediction.

Here is a model opening: ‘The legal issue is whether Supermart owes a duty of care to Lucy as a customer. Under the Occupiers’ Liability Act 1957, a shop owes a common duty of care to lawful visitors. Lucy was a lawful visitor. The spilled milk created a foreseeable risk of slipping. The duty was likely breached because the spill was not cleaned for an hour and no warning sign was present. Causation is established on the ‘but for’ test – but for the spill, Lucy would not have fallen. Thus, the supermarket is likely liable in negligence.’
