1. Why Case Analysis Matters in GCSE Law | 案例分析在GCSE法律中的重要性

In the AQA GCSE Law specification, a significant proportion of marks comes from questions that ask you to apply the law to a given set of facts. You might be told about a dispute between neighbours, an incident in a shop, or an injury on a school trip. Your job is to identify the legal issues, explain the relevant rules from statutes and decided cases, and then argue how a court would resolve the problem. This is exactly what lawyers and judges do every day.

Developing case analysis skills early in Year 10 gives you a huge advantage. It helps you move beyond simple description (‘the defendant owed a duty of care’) and into the higher‑level skill of application (‘on these facts, the duty was breached because…’). The more you practise, the more natural this reasoning becomes, boosting your confidence and your marks in every topic from criminal law to tort and human rights.

2. The IRAC Framework: A Step‑by‑Step Approach | IRAC

To structure your case analysis, lawyers use a method called IRAC: Issue, Rule, Application, Conclusion. Once you internalise this framework, you will never stare at a blank page wondering where to start. Each step builds on the last, creating a logical and persuasive legal argument.

The ‘Issue’ stage requires you to pinpoint exactly what legal question the scenario raises. Instead of ‘This is about negligence’, be specific: ‘The issue is whether the defendant owed the claimant a duty of care for pure economic loss caused by a negligent statement.’ For criminal law, ask: ‘What offence has been committed and what is the key element in dispute – the actus reus, mens rea, or a defence?’

The ‘Rule’ step involves stating the legal principle, including the source – whether from a statute, such as the Theft Act 1968, or a leading case, such as Donoghue v Stevenson [1932] AC 562. Be precise with the test. For example: ‘For murder, the mens rea is an intention to kill or cause grievous bodily harm, following R v Vickers [1957] 2 QB 664.’ Never leave the rule hanging without authority.

‘Application’ is where you earn the most marks. Here you weave the facts of the scenario into the legal rule, using words like ‘because’ and ‘therefore’. Show how the defendant’s actions meet – or fail to meet – each part of the test. A strong application often considers both sides: why the prosecution or claimant has a strong case, but also what counter‑arguments the defendant might raise.

Finally, ‘Conclusion’ should be a short, direct answer to the issue you identified. Avoid sitting on the fence unless the facts genuinely allow two reasonable outcomes. Base your conclusion on the strength of your application. For example: ‘It is highly likely that a court would find the defendant liable for battery because the touching was both intentional and unlawful.’

3. Practice Case 1 – Criminal Law: Identifying Legal Issues |

Read the following scenario: Dan and Pete are neighbours. After an argument about loud music, Dan, in a fit of anger, rips a gas pipe from the wall of his own flat to stop Pete’s electricity generator outside, not realising that gas will seep into Pete’s flat next door. Pete inhales the gas and is hospitalised with serious lung damage. When interviewed, Dan says, ‘I only wanted to stop the noise; I never thought anyone would get hurt.’

Your first task is to identify the legal issues. Here, the most serious consequence is the injury to Pete. So the primary issue is whether Dan can be criminally liable for an offence against the person. The facts suggest possible offences under the Offences Against the Person Act 1861 – perhaps maliciously administering a noxious thing (s.23) or inflicting grievous bodily harm (s.20). The key legal question is: does Dan have the required mens rea when he claims he did not intend or foresee the risk of harm?

4. Practice Case 1 – Stating the Relevant Legal Rule |

To answer this, you must accurately state the legal rule for ‘malice’ in non‑fatal offences. The leading case is R v Cunningham [1957] 2 QB 396. There, the defendant tore a gas meter from the cellar wall to steal money inside. He left gas escaping, which seeped into a neighbouring house and partially asphyxiated a woman. The Court of Appeal held that for the purposes of s.23 of the 1861 Act, ‘maliciously’ does not require any ill‑will or hatred. It means that the defendant intended to cause the harm, or was subjectively reckless as to whether such harm might occur.

Subjective recklessness in Cunningham means that the prosecution must prove that the defendant himself foresaw the risk of the particular type of harm and nonetheless went on to take that risk unreasonably. It is not enough that a reasonable person would have foreseen the risk; the focus is on what the defendant actually thought. This is a crucial distinction from the objective test used in the later case of R v Caldwell [1982] AC 341, which is no longer good law for most offences.

5. Practice Case 1 – Applying the Rule to Dan’s Case |

Now we apply the Cunningham test to Dan. The harm Pete suffered is serious lung damage, which clearly amounts to the actus reus of both administering a noxious thing and inflicting GBH. The gas pipe is a noxious thing because it was capable of causing injury. The critical question is whether Dan was subjectively reckless. His statement – ‘I never thought anyone would get hurt’ – directly raises the issue of foresight.

A prosecutor would argue that by deliberately ripping a gas pipe from the wall, Dan must have realised there was a risk of gas escaping and causing harm, even if his primary motive was to stop the noise. The fact that the pipe was in his own flat does not eliminate the risk to neighbours. However, the defence would emphasise Dan’s honest belief and lack of awareness. If the court accepts that Dan genuinely did not foresee any risk of injury, then the mens rea for a s.23 or s.20 offence is not made out. The result would hinge on whether the magistrates or jury believe Dan’s account.

6. Practice Case 1 – Reaching a Conclusion |

On balance, the prosecution faces a significant hurdle. The subjective test requires proof of Dan’s actual awareness. If there is no other evidence – such as a warning sign on the pipe or a history of gas leaks – to contradict his claim, it is difficult to prove beyond reasonable doubt that he foresaw the risk. Therefore, a court is likely to find Dan not guilty of the malicious offences, although he might still face civil liability in tort for negligence. This conclusion illustrates how a single word in the law (‘maliciously’) can determine the outcome of a case.

7. Practice Case 2 – Tort Law: Donoghue v Stevenson Style Scenario |

Now let us turn to a tort scenario, designed to test your understanding of the neighbour principle from Donoghue v Stevenson [1932] AC 562. Scenario: Maya buys a pre‑packaged fruit smoothie from a supermarket. She drinks half of it and then feels a sharp pain. She discovers a broken blade from a blender inside the bottle, which has cut her mouth and caused internal injuries. The smoothie was bottled by FruityCo Ltd. Maya wants to sue FruityCo for negligence, but she did not buy the drink directly from them – her contract was with the supermarket.

Identify the legal issue. The problem is whether FruityCo, as the manufacturer, owes a duty of care to Maya, a consumer who did not buy the product directly from them. In 1932 it was unclear whether such a duty existed without a contractual relationship, so the House of Lords had to clarify the law. Today, the principle is well established, but you still need to articulate it precisely using IRAC.

8. Practice Case 2 – Issue and Rule: The Neighbour Principle |

The issue is whether FruityCo owed Maya a duty of care to prevent the harm caused by the hidden blade. The relevant rule comes from Lord Atkin’s famous neighbour principle in Donoghue v Stevenson. The rule states that a person must take reasonable care to avoid acts or omissions which they can reasonably foresee would be likely to injure their neighbour. A neighbour is anyone who is so closely and directly affected by the act that the defendant ought reasonably to have them in contemplation when directing their mind to the act or omission in question.

Furthermore, Lord Atkin clarified that a manufacturer of products owes a duty to the ultimate consumer where the product reaches the consumer in the form in which it left the manufacturer, without any reasonable possibility of intermediate examination. This was a landmark extension of the law of negligence because it removed the requirement of privity of contract.

9. Practice Case 2 – Application and Conclusion |

Applying this rule to Maya’s smoothie, FruityCo manufactured the drink and bottled it in a sealed container. There was no realistic chance that the supermarket or anyone else would open the bottle to inspect for a hidden blade. It was clearly reasonably foreseeable that if a dangerous foreign object was left inside, a consumer like Maya would be injured upon drinking. Maya is precisely the ‘neighbour’ that FruityCo should have had in mind.

Therefore, following Donoghue v Stevenson, FruityCo owed Maya a duty of care. The breach of that duty seems clear on the facts, because a reasonable manufacturer would operate a system to prevent blades from falling into bottles. A court would almost certainly find FruityCo liable in negligence, allowing Maya to recover damages for her physical injury and any consequential loss. The conclusion reinforces the continued relevance of the snail in the ginger beer bottle – a case decided almost a century ago.

10. Advanced Technique: Distinguishing and Analogising |

Examiners reward candidates who go beyond a mechanical statement of the rule and show an understanding of how courts use precedent. Two powerful tools are distinguishing and analogising. Distinguishing means pointing out material differences between the facts of the precedent case and the facts of the problem scenario, such that the earlier decision should not be binding. For example, if in Dan’s case there had been a warning hiss of gas that a court found he ignored, you could distinguish Cunningham because in Cunningham the defendant had deliberately damaged the pipe and clearly knew the risk, strengthening the inference of foresight.

Analogising means arguing that the material facts are so similar to those of a precedent that the same outcome should follow. In the smoothie scenario, you can draw a powerful analogy to the sealed bottle of ginger beer in Donoghue and argue that the same duty must exist. Mastering these techniques shows the examiner that you are thinking at a higher level and understand how the common law evolves.

11. Self‑Assessment and Common Mistakes to Avoid |

After practising a few case analyses, use a simple checklist to mark your own work. Check that you have identified the right legal issue, stated the rule with a named case or statute, applied the facts using ‘because’, and reached a clear conclusion. Look out for these typical AQA pitfalls: confusing actus reus with mens rea, using an outdated precedent (like the objective Caldwell recklessness for non‑fatal offences), forgetting to consider causation in result crimes, and writing a conclusion that restates the issue without answering it.

Another common weakness is unbalanced application. Some students only argue the claimant’s or prosecution’s side. Top answers always anticipate and rebut counter‑arguments. If a defendant might have a defence, such as self‑defence or mistake, address it even if you ultimately reject it. This demonstrates thorough legal reasoning and impresses the examiner.

12. Final Tips and Revision Focus |

As your Year 10 exams approach, integrate case analysis into your regular revision routine. Pick a topic – say, non‑fatal offences – and write your own short scenarios for a study partner. Swap papers and apply IRAC, then discuss where you agree or disagree. This active method embeds the material far more effectively than passive reading. Keep a notebook of key precedents with a one‑line rule statement, such as ‘R v Cunningham = subjective recklessness for malice’ to speed up recall.

Remember that case analysis is a skill that improves with practice. Do not be discouraged if your early attempts feel messy. Focus on clarity and structure first; elegance and conciseness will follow. When you sit down to write your AQA law paper, the IRAC framework will be your reliable guide. Approach each scenario calmly, break it down step by step, and show the examiner that you have truly learned to think like a lawyer.
