1. Introduction to Law and the English Legal System |
Law is a formal set of rules created by the state to regulate behaviour, protect rights and maintain order. In the English legal system, these rules are made by Parliament, developed by judges through case law, and enforced through a court hierarchy. The system is adversarial, meaning that two opposing parties present their cases before an impartial judge or jury. The study of law at this level involves understanding sources of law, court structure, legal personnel, and the operation of both criminal and civil justice.
2. Sources of Law: Statute Law and Judicial Precedent |
The two principal sources of law in England and Wales are statute law and judicial precedent. Statute law, also called legislation, is created by Parliament. It takes the form of Acts of Parliament and delegated legislation such as statutory instruments. Judicial precedent, or case law, is created when judges make decisions that set binding rules for future cases under the doctrine of stare decisis, meaning ‘to stand by decisions’. The binding part of a judgment is the ratio decidendi, while any remarks made in passing are obiter dicta, which may be persuasive but not binding.
3. Court Structure and Hierarchy |
Courts in England and Wales are organised by subject matter and importance. For criminal cases, the hierarchy begins with the Magistrates’ Court for summary offences, rises to the Crown Court for indictable offences, and appeals proceed to the Court of Appeal (Criminal Division) and finally the Supreme Court. For civil cases, the County Court and High Court are the main trial courts, with appeals going to the Court of Appeal (Civil Division) and then the Supreme Court. The Supreme Court is the highest domestic court, and its decisions bind all courts below.
| Criminal Courts | Civil Courts |
|---|---|
| Supreme Court | Supreme Court |
| Court of Appeal (Criminal) | Court of Appeal (Civil) |
| Crown Court | High Court |
| Magistrates’ Court | County Court |
4. Legal Personnel: Judges, Barristers and Solicitors |
The legal profession is divided into barristers and solicitors, though some differences are narrowing. Solicitors are the first point of contact for clients; they advise, prepare documents, and may represent clients in lower courts. Barristers specialise in advocacy and provide specialist legal opinions; traditionally they had exclusive rights of audience in higher courts, but solicitor-advocates now share this role. Judges are appointed from experienced barristers or solicitors and perform a range of roles from part-time magistrates to full-time Circuit Judges and High Court Judges. All legal professionals are bound by ethical codes and must maintain independence.
5. Criminal and Civil Law Distinctions |
Criminal law concerns offences considered harmful to society, and cases are brought by the state (usually the Crown Prosecution Service) against an individual or organisation. The aim is to punish wrongdoing through sentences such as imprisonment, fines or community orders. The standard of proof is ‘beyond reasonable doubt’. Civil law deals with disputes between individuals or businesses, such as contract breaches, negligence or family matters. The claimant sues the defendant seeking a remedy, often damages. The standard of proof is ‘on the balance of probabilities’. These differing purposes and procedures are fundamental to understanding how justice is delivered.
6. Criminal Process: Arrest to Trial |
When a crime is suspected, the police can arrest a person if they have reasonable grounds and the arrest is necessary. The arrested person is taken to a police station where they are informed of their rights, including the right to free legal advice. They may be held for questioning and then either released, bailed or charged. If charged, the first court appearance is at the Magistrates’ Court. For serious indictable offences, the case is sent to the Crown Court. The trial involves prosecution and defence presenting evidence, and a verdict is reached by magistrates or a jury. Sentencing follows a guilty verdict.
7. Civil Process: Resolving Disputes |
Civil disputes can be resolved through negotiation, mediation or formal court action. Most cases are settled out of court. When a claim is filed, the claimant uses the appropriate claim form and serves it on the defendant. The court manages the case using pre-action protocols and directions to encourage early settlement and proportionate costs. Small claims (typically under £10,000) are dealt with in the County Court’s small claims track, which is less formal and encourages litigants in person. Larger claims proceed on the fast track or multi-track. If the matter goes to trial, a judge decides on liability and remedy.
8. Introduction to Tort Law: Negligence |
Tort law provides remedies for civil wrongs, primarily through awards of damages. The most significant tort is negligence, which arises when a duty of care owed by one person to another is breached, causing damage. To establish negligence, a claimant must prove three elements: (1) the defendant owed them a duty of care, (2) that duty was breached, and (3) the breach caused foreseeable damage that is not too remote. The neighbour principle from Donoghue v Stevenson sets the foundation for duty of care. Breach is judged by the standard of the reasonable person, and causation uses the ‘but for’ test and consideration of remoteness of damage.
9. Criminal Law: Elements of a Crime (Actus Reus and Mens Rea) |
Most criminal offences require proof of two things: the actus reus (guilty act) and the mens rea (guilty mind). The actus reus may consist of a voluntary act, an omission (in limited circumstances where a duty exists), or a state of affairs. The mens rea refers to the mental element, such as intention, recklessness, or negligence, depending on the offence. For example, murder requires an intention to kill or cause grievous bodily harm, while theft requires dishonesty and an intention to permanently deprive. Both elements must coincide in time for liability to arise.
10. Non-fatal Offences Against the Person |
Non-fatal offences are set out mainly in the Offences Against the Person Act 1861, and range from minor to serious charges. Common assault and battery are summary offences: assault is causing the victim to apprehend immediate unlawful force, while battery is the actual application of unlawful force. Actual bodily harm (ABH) is an either-way offence defined as ‘any hurt or injury calculated to interfere with the health or comfort of the victim’, often charged under s.47. More serious are grievous bodily harm (GBH) under s.20 (wounding or inflicting GBH) and s.18 (wounding or causing GBH with intent), which carry heavier sentences.
11. Contract Law: Offer and Acceptance |
Contracts are legally binding agreements, and the essential elements of a valid contract are offer, acceptance, consideration and an intention to create legal relations. An offer is a definite promise to be bound on certain terms, which may be made to an individual or to the world at large (as in Carlill v Carbolic Smoke Ball Co). It must be distinguished from an invitation to treat, which is an invitation to negotiate (e.g. goods on a shop shelf). Acceptance must be unconditional and communicated to the offeror; silence generally cannot amount to acceptance. Once acceptance occurs, a binding contract is formed.
12. Family Law: Marriage and Divorce |
Family law governs legal relationships between partners and between parents and children. Marriage creates a formal, legally recognised union between two people. To be valid, a marriage must comply with formalities such as notification, ceremony, and capacity requirements (e.g. age, not already married). Same-sex marriage has been lawful since 2014. Divorce dissolves the marriage; under the Divorce, Dissolution and Separation Act 2020, the sole ground for divorce is irretrievable breakdown, proved by a statement. Couples can now apply jointly, and no blame needs to be assigned. The court must also consider arrangements for children and finances.
