5. Murder & Voluntary Manslaughter Formula | 谋杀与自愿过失杀人公式

Murder is defined as the unlawful killing of a reasonable creature in being under the Queen’s peace, with intent to kill or cause grievous bodily harm (Coke’s definition, modernised in Moloney). If the defendant successfully raises a partial defence, the conviction is reduced to voluntary manslaughter.

The two principal partial defences in Year 12 are loss of control (Coroners and Justice Act 2009, ss.54–55) and diminished responsibility (Homicide Act 1957, s.2 as amended by CJA 2009, s.52). Loss of control requires: (1) a qualifying trigger — fear of serious violence or a thing said/done which constituted circumstances of an extremely grave character and caused a justifiable sense of being seriously wronged; (2) a person of the defendant’s sex and age, with a normal degree of tolerance and self‑restraint, might have reacted in the same way. Diminished responsibility requires: abnormality of mental functioning arising from a recognised medical condition, which substantially impaired the defendant’s ability to understand the nature of their conduct, form a rational judgment or exercise self‑control, and which provides an explanation for the killing.

Where a defendant causes death without the mens rea for murder but in circumstances deserving criminal sanction, involuntary manslaughter arises. The two key forms tested are unlawful act manslaughter and gross negligence manslaughter.

The unlawful act must be an act, not an omission (Lowe), and the reasonable sober person would recognise a risk of some harm, not necessarily serious harm (Larkin; JM and SM). For gross negligence manslaughter (Adomako), five elements must be established: (1) a duty of care existed; (2) the duty was breached; (3) the breach caused death; (4) the breach created a risk of death (R v Rose); and (5) the negligence was truly “gross” — so far below the standard of a reasonable person as to merit criminal condemnation.

Theft is defined in s.1 Theft Act 1968 as the dishonest appropriation of property belonging to another with the intention of permanently depriving the other of it. Robbery is an aggravated form of theft under s.8 where force is used immediately before or at the time of stealing.

Dishonesty is now judged by the Ivey test: (1) what was the defendant’s actual state of knowledge or belief as to the facts? (2) was the defendant’s conduct dishonest by the objective standards of ordinary decent people? The s.2 exceptions (belief in a legal right, consent or that the owner cannot be discovered) are no longer straightforward loop‑holes but feed into the factual assessment. For robbery, the defendant must have committed or attempted theft and at the same time used force or put a person in fear of subjection to force (R v Dawson and James; B and R v DPP).

Remoteness is governed by the Wagon Mound No 1: damage must be of a reasonably foreseeable type, though the extent need not be foreseeable (Bradford v Robinson Rentals).

Alongside Caparo, the incremental approach — finding a gradually expanding set of analogous categories — is used to keep the law predictable (Robinson v Chief Constable of West Yorkshire Police).

Occupiers’ liability is governed by two separate statutes: the Occupiers’ Liability Act 1957 applies to lawful visitors; the Occupiers’ Liability Act 1984 applies to trespassers. The starting point is always to identify the occupier(s) — the person(s) with control over the premises (Wheat v E Lacon).

A visitor who exceeds their permission (scope of invitation) may become a trespasser (The Calgarth). Under OLA 1984, a duty is owed if (1) the occupier is aware of the danger or has reasonable grounds to believe it exists; (2) the occupier knows or has reasonable grounds to believe a trespasser is in or may come into the vicinity of the danger; and (3) the risk is one against which the occupier may reasonably be expected to offer some protection. The duty is to take such care as is reasonable in all the circumstances to see that the trespasser does not suffer injury on the premises by reason of the danger concerned (s.1(3)–(5)).
