1. The Criminal Liability Formula | 刑事责任公式

The great majority of criminal offences can be expressed through a simple equation: actus reus (the guilty act) combined with mens rea (the guilty mind), minus any valid defence, results in criminal liability. The prosecution bears the burden of proving both the actus reus and the mens rea beyond reasonable doubt. The actus reus must be a voluntary act or omission, as seen in R v Larsonneur (1933) where even involuntary presence was sufficient, though modern law requires some voluntary conduct. Mens rea forms vary: intention (direct or oblique, as defined in R v Woollin [1999]), recklessness (the subjective taking of an unjustifiable risk, R v Cunningham [1957]), or, in certain statutory offences, negligence or strict liability where no mens rea is needed at all (e.g. Callow v Tillstone (1900)). When a defence, such as self-defence or automatism, is successfully raised, the defendant is acquitted.

2. The Causation Test | 因果关系检验

Where a result crime is charged, the prosecution must prove that the defendant’s conduct caused the prohibited consequence. The formula for causation involves two limbs: factual causation and legal causation. Factual causation is determined by the ‘but for’ test: but for the defendant’s actions, would the result have occurred? In R v White [1910], the defendant put cyanide in his mother’s drink, but she died of a heart attack before the poison took effect: the ‘but for’ test was not satisfied. If factual causation is established, legal causation demands that the defendant’s act was a substantial and operating cause of the harm, and that no intervening act (novus actus interveniens) broke the chain of causation. In R v Smith [1959], a soldier’s wound was still the operating cause of death even though his medical treatment was poor. Only wholly unforeseeable events or a third party’s free, deliberate and informed act will usually break the chain.

3. The Delict of Negligence Equation | 过失侵权方程式

Under Scots law, negligence is a delict. To succeed in a claim, the pursuer must prove each of the following components. The starting point is that a duty of care was owed, which was famously established by the neighbour principle in Donoghue v Stevenson 1932 SC (HL) 31: you must take reasonable care to avoid acts or omissions which you can reasonably foresee would likely injure your neighbour. Once a duty is established, a breach of that duty occurs when the defender’s conduct falls below the standard of the reasonable person (Muir v Glasgow Corporation 1943). The pursuer must then prove that the breach caused the harm (both in fact and in law), and that the harm was not too remote – the type of damage must be reasonably foreseeable (Hughes v Lord Advocate [1963]). Finally, the pursuer must have suffered actual loss or injury.

4. Contract Creation Formula | 合同成立公式

A contract in Scots law is formed when an offer is met by an unqualified acceptance, accompanied by an intention to create legal relations. Unlike English law, Scots law does not require consideration; a gratuitous promise can be binding if made with the necessary intent. An offer must be distinguished from an invitation to treat (Pharmaceutical Society of Great Britain v Boots Cash Chemists [1953]). Acceptance must exactly mirror the offer, and the postal rule applies unless excluded: acceptance is effective when a letter is posted, not when received (Adams v Lindsell (1818)). For social or domestic agreements there is a presumption against an intention to create legal relations, while in commercial contexts the presumption is reversed.

5. The Precedent Doctrine | 先例原则

Judicial precedent, or stare decisis, requires lower courts to follow the decisions of higher courts in cases with materially similar facts. The binding part of a judgment is the ratio decidendi – the legal reasoning essential to the decision. Statements made ‘by the way’ are obiter dicta and are persuasive but not binding. The hierarchy of courts is crucial: decisions of the UK Supreme Court bind all courts below it; decisions of the Inner House of the Court of Session in Scotland bind lower Scottish courts but not English ones. Precedent brings certainty and consistency, but can be rigid; the Supreme Court may however depart from its own previous decisions when it appears right to do so, using the Practice Statement 1966.

6. Rules of Statutory Interpretation | 成文法解释规则

When the meaning of an Act is ambiguous, courts apply established rules of interpretation. The literal rule gives words their plain, ordinary meaning, even if this produces an absurd result (R v Harris (1836)). The golden rule allows the court to modify the literal meaning to avoid absurdity, as in Re Sigsworth [1935] where a son who murdered his mother was prevented from benefiting under her intestacy. The mischief rule looks at the gap or ‘mischief’ that Parliament intended to remedy (Smith v Hughes [1960]). Modern courts increasingly adopt the purposive approach, which interprets legislation in line with its overall purpose, influenced by EU and ECHR jurisprudence. Extrinsic aids such as Hansard may also be consulted under Pepper v Hart [1993].

7. Defences to a Crime | 刑事抗辩事由

A complete defence removes criminal liability even where the actus reus and mens rea are present. Self-defence, including defence of another, is available where the accused used reasonable force in response to an imminent attack, as laid out in HM Advocate v Doherty 1954 JC 1. The plea of automatism requires that the accused was not in conscious control of their actions due to an external factor (e.g. a blow to the head), while insanity is governed by the M’Naghten Rules which require a defect of reason caused by disease of the mind. Intoxication, whether voluntary or involuntary, can sometimes negate specific intent, but in Scots law voluntary intoxication is not generally a defence to crimes of basic intent. Coercion, necessity and incitement are other limited defences recognised under specific circumstances.

8. Sentencing Factors | 量刑因素

When determining an appropriate sentence, the court balances the aggravating and mitigating factors of the offence and the offender. Aggravating factors include premeditation, use of a weapon, targeting a vulnerable victim, offending while on bail, and previous convictions. Mitigating factors include an early guilty plea, genuine remorse, minor role in the offence, provocation that does not amount to a defence, and the offender’s youth or mental health issues. In Scots law, the court must have regard to the purposes of sentencing set out in the Sentencing Council guidelines, including punishment, deterrence, rehabilitation and protection of the public. A custodial sentence should only be imposed where no other method of dealing with the offender is appropriate.

9. Admissibility of Evidence | 证据可采性规则

All evidence must be relevant to be admissible, but certain categories face additional restrictions. Hearsay – a statement made outside court to prove the truth of its content – is generally inadmissible unless a statutory exception applies (under the Civil Evidence (Scotland) Act 1988 or the Criminal Procedure (Scotland) Act 1995). In Scots criminal law, corroboration is required: there must be two independent sources of evidence pointing to the accused’s guilt. Similar fact evidence or evidence of bad character is admissible only if its probative value substantially outweighs any prejudicial effect. Confessions are admissible provided they were fairly obtained; an interview in breach of the procedural rules may be excluded for unfairness.

10. Proportionality in Judicial Review | 司法审查的比例原则

Judicial review is the procedure by which the Court of Session supervises the lawfulness of decisions made by public bodies. One of the key grounds of review is that the decision was disproportionate, particularly where human rights are engaged. Under the Human Rights Act 1998, a court must assess whether a limitation on a qualified right (such as the right to respect for private life under Article 8 ECHR) was ‘necessary in a democratic society’ and proportionate to the legitimate aim pursued. The proportionality test asks whether the measure was suitable, whether a less intrusive alternative was available, and whether a fair balance was struck between the individual’s rights and the public interest. This formula has become a crucial check on administrative power in Scotland.
