1. Sources of Scots Law |
Scots law has a unique mixed heritage, drawing from various sources. The primary formal source is legislation enacted by both the UK Parliament and the Scottish Parliament. Acts of the Scottish Parliament can only legislate on devolved matters, while the UK Parliament retains authority over reserved issues such as defence and foreign affairs. Another crucial source is judicial precedent, where decisions of higher courts bind lower ones. Institutional writings, such as Stair’s ‘Institutions of the Law of Scotland’, hold persuasive authority in areas where statute and precedent are unclear. Custom, although rare today, can still form part of the common law where it has been continuously observed and accepted as legally binding.
2. The Court System in Scotland |
Scotland has a distinct court structure for criminal and civil cases. For criminal matters, the High Court of Justiciary sits as the supreme criminal court, dealing with serious offences such as murder and rape on indictment. The Sheriff Court handles the majority of criminal cases, and the Justice of the Peace Court deals with minor offences. In civil cases, the Court of Session is the supreme civil court, with an Outer House for first instance claims and an Inner House for appeals. The Sheriff Court also has extensive civil jurisdiction, while the UK Supreme Court remains the final court of appeal for civil matters from Scotland.
3. Elements of a Crime |
To establish criminal liability in Scots law, two fundamental elements must generally be proved: the actus reus (the guilty act) and the mens rea (the guilty mind). Actus reus refers to the prohibited conduct, which can be an act, an omission where there is a legal duty to act, or a state of affairs. Mens rea is the mental element, with common forms including intention, recklessness and in some crimes, such as assault, the mental state of ‘evil intent’. The actus reus and mens rea must coincide in time for a conviction to be secured. Some offences, known as strict liability offences, do not require proof of mens rea for a guilty finding, for example many road traffic offences.
4. Defences in Criminal Law |
Accused persons may rely on a number of defences to avoid or reduce liability. Self-defence is available where the accused used reasonable force in response to an imminent attack. The defence of mental disorder, which replaced the old insanity plea, applies when the accused lacked the ability to appreciate the nature or wrongfulness of their conduct due to a mental condition. Duress can be pleaded when the accused was compelled to commit an offence under threat of immediate death or serious bodily harm. Other significant defences include necessity, where the accused acted to prevent a greater harm, and automatism, which involves involuntary action without conscious control.
5. Civil Liability: Contract and Delict |
Civil liability in Scots law arises mainly from contract and delict. A contract is formed when there is an offer, acceptance and an intention to create legal relations. Unlike English law, Scots law does not require consideration for a contract to be binding, although a gratuitous promise may need to be in writing. Breach of contract entitles the injured party to remedies such as damages. Delict refers to wrongful conduct causing harm to another. The most common delict is negligence, which requires a duty of care, a breach of that duty by the defender, and resultant damage that is not too remote. Other delicts include defamation, nuisance and trespass.
6. Law-making: Legislation and Delegated Legislation |
Primary legislation in Scotland is made by the Scottish Parliament in devolved areas such as health, education and criminal law, and by the UK Parliament in reserved matters. The legislative process in Holyrood involves a bill passing through stages including general debate, committee scrutiny and final vote, before receiving royal assent. Delegated legislation, made by government ministers or other bodies under powers granted by an enabling Act, allows detailed rules to be created without a new full bill. Statutory instruments are the most common form. They are essential for technical and administrative efficiency, but are subject to controls through parliamentary scrutiny and judicial review.
7. Judicial Precedent |
Judicial precedent operates on the principle of stare decisis, meaning ‘to stand by decided matters’. A court must follow the decisions of a higher court in its hierarchy. The ratio decidendi, or the legal reason for the decision, is the binding part of a judgment. Courts can use different techniques to avoid a precedent, such as distinguishing the facts of the case, overruling a lower court’s decision, or declaring the previous decision per incuriam if it was made in ignorance of a relevant statute. The hierarchy of courts determines which precedents bind which; for example, decisions of the Inner House of the Court of Session bind the Outer House and lower civil courts.
8. Introduction to Human Rights Law |
The Human Rights Act 1998 incorporated most of the rights set out in the European Convention on Human Rights (ECHR) into UK law. Public authorities must act in a way compatible with these rights, and courts must interpret legislation so far as possible in accordance with them. Key rights include the right to life (Article 2), prohibition of torture (Article 3), right to a fair trial (Article 6), right to respect for private and family life (Article 8) and freedom of expression (Article 10). These rights are qualified or subject to lawful restrictions in some cases, and the Scottish Parliament cannot legislate contrary to Convention rights.
9. Legal Personnel and Access to Justice |
A range of legal personnel keep the Scottish system functioning. Solicitors provide initial legal advice and handle most courtroom work in the sheriff courts. Advocates, the equivalent of barristers, specialise in presenting cases before the higher courts. Judges preside over cases to ensure a fair trial, with sheriffs in lower courts and senators of the College of Justice in the supreme courts. Access to justice is supported by legal aid, which provides public funding for eligible individuals. Alternative dispute resolution methods such as mediation and arbitration also help parties resolve disputes without full court proceedings.
