The core non-fatal offences against the person are assault, battery, assault occasioning actual bodily harm (ABH) under s.47 Offences Against the Person Act 1861, malicious wounding or inflicting grievous bodily harm (GBH) under s.20, and wounding or causing GBH with intent under s.18. Assault is causing someone to apprehend immediate unlawful force; battery is the actual infliction of unlawful force. Both are common law offences with no requirement of actual injury.

Section 18, the most serious, requires intent to cause GBH or to resist arrest and carries a maximum of life imprisonment. You must be able to distinguish the offences by actus reus and mens rea.

Negligence is the premier tort in AQA Law. To succeed, a claimant must establish a duty of care, breach of that duty and damage caused by the breach. The modern test for duty of care derives from Caparo Industries plc v Dickman (1990): proximity or neighbourhood, foreseeability of harm, and whether it is fair, just and reasonable to impose a duty. In many established situations — driver to road user, doctor to patient — the duty is automatically recognised.

Breach of duty occurs when the defendant falls below the standard of the reasonable person. Judges consider factors such as the likelihood of harm (Bolton v Stone (1951) — cricket ball hit very rarely out of the ground), the seriousness of potential harm (Paris v Stepney BC (1951) — known one-eyed worker needed extra protection), the social value of the defendant’s activity and the practicality of taking precautions. A defendant will be in breach if the risk of injury was reasonably foreseeable and they failed to act as a reasonable person would have done.

Once breach is established, the claimant must prove factual causation (the ‘but for’ test) and legal causation — the damage must not be too remote. The test in The Wagon Mound (No 1) (1961) says that damage is reasonably foreseeable in type, even if the precise extent is unpredictable. An eggshell skull rule applies: the defendant must take the victim as they find them (Smith v Leech Brain (1962)).

Compare the statutory requirements and the cases that interpret ‘occupier’ and ‘premises’.
