1. Actus Reus and Mens Rea | 犯罪行为与犯罪意图

The physical element of a crime is the actus reus – the guilty act. It can be an action, a failure to act (omission), or a state of affairs. In result crimes, the prosecution must also prove that the defendant’s conduct caused the prohibited consequence (causation).

2. Causation: Factual and Legal | 因果关系:事实与法律

Factual causation uses the ‘but for’ test: but for the defendant’s conduct, would the result have occurred? If the answer is ‘no’, factual causation is established (R v White).

Legal causation requires the defendant’s act to be a substantial and operating cause of the result. It need not be the only cause. An omission is a failure to act. In English law there is no general duty to rescue a stranger, but liability arises where a legal duty to act exists. The five key duty situations examined at OCR are: statutory duty, contractual duty, duty because of a relationship, duty taken on voluntarily, and duty created by the defendant’s own conduct (creating a dangerous situation – R v Miller).

4. Strict Liability | 严格责任

Strict liability offences require no proof of mens rea for at least one element of the actus reus. They are often regulatory offences dealing with issues of social concern, such as food safety, pollution, and sale of age-restricted products. The leading case is Callow v Tillstone, where a butcher was convicted of selling unfit meat even though a vet had approved it.

Battery is the actual infliction of that unlawful force, however slight (Collins v Wilcock).

Section 18 requires wounding or causing GBH with intent – the most serious, carrying a maximum life sentence.

Automatism is a complete defence where the defendant’s act was involuntary due to an external factor, such as a brick hitting the head (Hill v Baxter). Insanity is a special verdict (not guilty by reason of insanity) and relies on internal factors – the M’Naghten Rules: defect of reason, caused by a disease of the mind, leading to the defendant not knowing the nature and quality of the act or not knowing it was legally wrong.

Duress of circumstances covers situations like R v Willer where driving on a pavement was necessary to escape a threatening gang.

8. The Doctrine of Precedent | 遵循先例原则

The English legal system operates on stare decisis – to stand by decisions and not unsettle established law. The binding part of a judgment is the ratio decidendi (the legal reasoning for the decision). The non-binding commentary is obiter dicta (things said by the way), which can be highly persuasive in later cases.

The important practice statement of 1966 allows the Supreme Court to depart from its own precedent when it appears right to do so.

9. Statutory Interpretation | 制定法解释

Judges must interpret Acts of Parliament, and they use three main approaches. The literal rule gives words their ordinary, dictionary meaning even if it leads to absurdity (Whitely v Chappell – a dead man could not vote). The golden rule avoids an absurd result by modifying the literal meaning: narrow approach chooses between possible meanings; wide approach alters the meaning to avoid repugnance (Re Sigsworth – a son who murdered his mother could not inherit her estate).

The purposive approach goes further, asking what Parliament intended to achieve, and is widely used in European-influenced contexts and human rights law.

10. The Civil Court System and Appeals | 民事法院体系与上诉

The civil justice system aims to resolve disputes between individuals and organisations. The two main trial courts are the County Court (for claims up to a certain value, small claims track, fast track, multi-track) and the High Court (King’s Bench, Chancery, and Family Divisions).

民事司法体系旨在解决个人和组织之间的纠纷。两个主要的审判法院是郡法院(处理一定金额以下的索赔,设有小额索赔轨道、快车道和多轨道)和高等法院(王座庭、大法官庭和家事庭)。
