4. Criminal Law: General Principles | 刑法:一般原则

Scottish criminal law is largely based on common law with some statutory modifications. Actus reus must be a voluntary act or omission, and it must cause the prohibited result for result crimes. Mens rea can take different forms: intention (the most serious), recklessness, or, in some statutory offences, strict liability where mens rea is not required. The prosecution must prove both elements beyond reasonable doubt.

Sexual offences such as rape and sexual assault are serious crimes defined by statute and common law.

Mental disorder can negate criminal responsibility if, at the time of the act, the accused was unable to appreciate the nature or wrongfulness of their conduct. Automatism (involuntary action caused by external factors, not self-induced) and coercion (threat of immediate death or serious injury) are also recognised.

The neighbour principle from Donoghue v Stevenson (1932) established that one must take reasonable care to avoid acts or omissions that could foreseeably harm others. The modern three-part test from Caparo v Dickman (1990) considers proximity and whether it is fair, just and reasonable to impose a duty.
