📚 Year 13 AQA Law: Common Misconceptions and Correction Methods | Year 13 AQA
As students advance through Year 13 AQA Law, they often encounter recurring misconceptions that can cost valuable marks in examinations. These misunderstandings typically arise from the subtle interplay between actus reus, mens rea, and the precise elements of defences or torts. This article identifies twelve frequent errors spanning criminal law, tort law, and human rights topics, and offers clear correction methods to help students refine their legal analysis and improve exam performance.
1. Confusing Murder and Unlawful Act Manslaughter |
Many students mistakenly treat unlawful act manslaughter (constructive manslaughter) as a form of murder when the mens rea for murder is absent. They assume that if a death results from any unlawful act, the defendant is automatically liable for murder.
Correction method: Murder requires an intention to kill or cause grievous bodily harm (GBH) under the principle in Vickers. If the defendant only intended the unlawful act (which must be dangerous on an objective test from Church) and death occurred, the correct charge is unlawful act manslaughter. Always verify the presence of malice aforethought before concluding murder.
2. Misapplying the Defence of Loss of Control |
A common error is to treat loss of control as a defence that applies whenever the defendant was angry or provoked. Students often forget the qualifying triggers set out in s.55 of the Coroners and Justice Act 2009 and the objective standard in s.54.
Correction method: Loss of control requires a loss of self-control that had a qualifying trigger (fear of serious violence, or things said/done which constituted circumstances of an extremely grave character and caused a justifiable sense of being seriously wronged) and that a person of the defendant’s sex and age, with a normal degree of tolerance and self-restraint, might have acted similarly. Sexual infidelity alone is excluded under s.55(6)(c). Structure your answer around the three-stage test from Clinton.
3. Misunderstanding Factual and Legal Causation |
Students frequently stop at factual causation (‘but for’ test) and fail to establish legal causation. They may also overlook the need for the defendant’s act to be a substantial and operating cause of the result, as explained in Smith and Cheshire.
Correction method: After applying the ‘but for’ test (White), you must show that the defendant’s contribution was more than minimal (Kimsey) and that there was no intervening act breaking the chain of causation. An intervening act will only break the chain if it is free, voluntary and informed (Pagett), or so potent as to render the original wound merely part of the history (Cheshire). Medical negligence rarely breaks the chain unless it is truly independent and extraordinary.
4. Incorrect Duty of Care Analysis in Negligence |
In tort law, students sometimes apply the three-stage test from Caparo v Dickman mechanically without considering established duty categories. They may also mistakenly treat ‘foreseeability of harm’ as sufficient on its own to establish a duty in novel situations.
Correction method: Where a previous authority has already imposed a duty (such as driver to road users, employer to employee, or doctor to patient), simply apply the precedent without reinventing the Caparo test. Only in novel situations should you use the three-stage test: foreseeability of damage, sufficient proximity, and whether it is fair, just and reasonable to impose a duty. Refer to Robinson v Chief Constable of West Yorkshire to support the incremental approach.
5. Conflating Assault and Battery |
It is extremely common for students to describe an assault when the facts clearly indicate a battery, or to treat the two offences as interchangeable. The distinction lies in whether physical contact has occurred.
Correction method: Assault is any act which intentionally or recklessly causes the victim to apprehend immediate and unlawful personal violence (Ireland). No touching is required. Battery is the actual infliction of unlawful personal force, even the slightest touch (Collins v Wilcock). Always ask: was there contact? If yes, battery; if only fear of immediate contact, assault. Use precise terminology in your answer.
6. Overextending Omissions Liability |
Students often fail to recognise that, in criminal law, an omission cannot establish actus reus unless a legal duty to act exists. They may incorrectly assert liability simply because the defendant ‘did nothing’ when they could have helped.
Correction method: The general rule is that there is no liability for omissions (Miller notwithstanding). A duty to act can arise through statute, contract, a special relationship, voluntary assumption of care, creation of a dangerous situation, or public office. Only if one of these exceptional duties applies can you treat an omission as satisfying the actus reus. Always identify and explain the specific duty, citing cases like Evans (created dangerous situation) or Gibbins and Proctor (parental duty).
7. Blurring Gross Negligence Manslaughter and Unlawful Act Manslaughter |
A significant number of students mix up the elements of gross negligence manslaughter (GNM) and unlawful act manslaughter. They may apply the ‘risk of obvious’ test to GNM or insert a requirement for an unlawful act into GNM.
Correction method: Both are forms of involuntary manslaughter but have distinct requirements. Unlawful act manslaughter requires an unlawful act that is objectively dangerous and causes death (DPP v Newbury). Gross negligence manslaughter (Adomako) applies where the defendant owed a duty of care, breached it so grossly as to deserve criminal sanction, and the breach caused death, with a risk of death that would have been obvious to a reasonable person (Broughton). There is no requirement of an unlawful act in GNM. Keep a checklist for each to avoid blending them.
8. Occupiers’ Liability: Misstating the Obviousness of Risk to Children |
Under the Occupiers’ Liability Act 1957, students often mistakenly believe that an occupier must eliminate all risks to child visitors. They may also misapply the ‘obvious risk’ concept from the 1984 Act to lawful visitors.
Correction method: The 1957 Act requires that an occupier be prepared for children to be less careful than adults (s.2(3)(a)), so risks that are hidden or tempting may still breach the common duty of care. However, if a risk is one that an ordinarily prudent parent would be expected to guard their child against, the occupier may not be liable (Phipps v Rochester Corporation). For adult visitors, obvious risks can often defeat a claim, but not automatically for children. Always consider whether parents would be expected to supervise.
9. Misclassifying ABH and GBH under s.47 and s.20/s.18 |
Students frequently mislabel the severity of harm and consequently cite the wrong section. They may charge s.47 (ABH) for injuries that amount to a wound or serious psychiatric harm, or incorrectly believe that s.20 requires an intention to cause GBH.
Correction method: ABH under s.47 requires harm that is more than transient or trifling but short of really serious harm (Miller). It includes psychiatric harm if recognisable. Malicious wounding or inflicting GBH under s.20 requires either a wound (break in both layers of skin) or really serious harm, but only intention or recklessness as to some harm (not necessarily serious). s.18 requires specific intent to cause GBH or to resist arrest. Use the hierarchy of harm to select the correct charge.
10. Diminished Responsibility: Forgetting the Abnormality of Mental Functioning |
When applying the partial defence to murder under s.2 Homicide Act 1957 as amended by s.52 Coroners and Justice Act 2009, students often list only recognised medical conditions and skip the requirement that they arose from an abnormality of mental functioning which substantially impaired the defendant’s ability.
Correction method: Diminished responsibility requires: (1) an abnormality of mental functioning; (2) arising from a recognised medical condition; (3) which substantially impaired the defendant’s ability to understand the nature of their conduct, form a rational judgment, and/or exercise self-control; and (4) provides an explanation for the killing. Every element must be evidenced, usually by medical experts. Do not just assert depression; link it to the statutory criteria.
11. Vicarious Liability: Confusing Employment Relationship and Course of Employment |
Students often treat vicarious liability as applicable whenever someone is at work, without analysing the two critical stages. They may also struggle with the ‘close connection’ test for intentional torts.
Correction method: Vicarious liability requires (1) a relationship akin to employment (Catholic Child Welfare Society factors) and (2) a tort committed in the course of employment. For course of employment, ask if the wrongful act was so closely connected with the authorised acts that it can fairly be regarded as done in the ordinary course of employment (Lister v Hesley Hall, Mohamud v WM Morrison). An intentional criminal act may still be within the course of employment if there is an unbroken connection between the employment and the tort. Always examine both stages separately.
12. Human Rights: Mistaking Absolute Rights and Qualified Rights |
Under the European Convention on Human Rights, students frequently misstate the nature of rights. They may treat qualified rights like Article 8 (private life) or Article 10 (expression) as absolute, or they may forget the concept of proportionality when applying restrictions.
Correction method: Absolute rights (e.g., Article 3 prohibition of torture, Article 4 prohibition of slavery) cannot be derogated from or balanced. Qualified rights may be restricted if the restriction is prescribed by law, pursues a legitimate aim, and is necessary in a democratic society (proportionate). Limited rights (e.g., Article 5 right to liberty) have specific exhaustive exceptions. For any restriction, always apply the Bank Mellat proportionality test: whether the objective is sufficiently important, whether the measure is rationally connected, whether a less intrusive measure could have been used, and whether a fair balance has been struck. Never describe Articles 8-11 as absolute.
