Law consists of a set of rules created by the state to regulate behaviour within society. Unlike moral rules, legal rules are enforceable through the courts and carry sanctions such as fines, imprisonment or compensation orders. Norms of morality may influence the creation of law, but they are not legally binding unless incorporated into legislation or recognized by judges.

Parliamentary sovereignty means that Parliament is the supreme law‑making body and no other authority can override an Act of Parliament.

Tribunals also play a vital role, particularly in employment and immigration matters.

For a defendant to be guilty of most crimes, the prosecution must prove two elements beyond reasonable doubt: the actus reus (the guilty act) and the mens rea (the guilty mind). The actus reus can be a positive act, a failure to act when there is a legal duty, or a state of affairs. The mens rea refers to the mental state required for the offence, such as intention (direct or oblique) or recklessness.

Assault and battery are common law offences; ABH and GBH are statutory. The distinction turns on the level of harm caused and the defendant’s mens rea.

The maximum sentences range from six months’ imprisonment for common assault to life imprisonment for s.18 GBH.

Murder is the unlawful killing of a human being under the Queen’s peace with malice aforethought (intention to kill or cause GBH). The mandatory sentence is life imprisonment. The actus reus includes an unlawful act or omission causing death. The mens rea is an intention to kill or to cause really serious injury.

Voluntary manslaughter arises when a defendant would otherwise be guilty of murder but a partial defence reduces liability. Diminished responsibility requires an abnormality of mental functioning arising from a recognised medical condition that substantially impaired the defendant’s ability to understand the nature of his conduct, form a rational judgement or exercise self‑control. Loss of control must result from a qualifying trigger, such as a fear of serious violence or things said or done that constituted circumstances of an extremely grave character and caused the defendant to have a justifiable sense of being seriously wronged.

Beyond partial defences to murder, general defences may completely acquit a defendant. These include intoxication, self‑defence, duress, necessity and automatism. Self‑defence and the prevention of crime allow reasonable force to be used, provided it is proportionate to the threat as the defendant honestly believed it to be. Duress arises when a defendant is forced to commit a crime under threat of death or serious injury, but it is not available for murder or some other serious offences.

For a defence to succeed, the defendant must put forward sufficient evidence to raise it, and the prosecution must then disprove it beyond reasonable doubt.

The neighbour principle from Donoghue v Stevenson established that one must take reasonable care to avoid acts or omissions that could foreseeably harm persons closely and directly affected.

Under the 1984 Act, a lesser duty is owed to trespassers where the occupier is aware of a danger and has reasonable grounds to believe a trespasser may come into the vicinity.

Digital content must meet similar standards, and services must be performed with reasonable care and skill. If goods are faulty, the consumer has a short‑term right to reject within 30 days and further rights to repair or replacement.

The Equality Act 2010 prohibits discrimination on grounds of age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex, and sexual orientation. These protections apply throughout the employment relationship, from recruitment to termination.

It requires public authorities to act compatibly with Convention rights, and where possible, legislation must be read and given effect in a way that is compatible with such rights. Courts may make a declaration of incompatibility if primary legislation cannot be interpreted consistently, though this does not invalidate the Act.

Aggravating and mitigating factors influence the type and length of sentence.
