However, subjective recklessness from R v Cunningham applies: if she foresaw the risk of some unlawful contact and went ahead anyway, she would be reckless. A deliberate slap in an argument strongly suggests either intention or recklessness. The court is likely to find she at least foresaw the risk of causing pain.

Breach is determined by the objective ‘reasonable person’ test from Blyth v Birmingham Waterworks. Causation uses the ‘but for’ test (Barnett v Chelsea Hospital). The damage must be of a foreseeable type (Wagon Mound).

The breach caused the injury: ‘but for’ the missing sign, Alex would not have slipped. The fracture is a foreseeable consequence of slipping on a hard floor. All elements of negligence are satisfied on the facts.
