1. Latin Legal Maxims Decoded |

Latin terms appear in every CAIE Law paper. Rather than rote learning, link each maxim to its literal meaning and a modern case. ‘Actus reus non facit reum nisi mens sit rea’ means ‘the act is not culpable unless the mind is guilty’. Picture a burglar in a cartoon — hands holding stolen goods (actus reus) but a speech bubble showing evil thoughts (mens rea). In R v G and Another (2003), the boys did not have the mens rea for criminal damage because they did not foresee the risk, illustrating the maxim perfectly.

R v G and Another

‘Stare decisis’ — stand by things decided. Visualise a judge physically standing by a pile of old law reports. The doctrine of precedent flows from this maxim. ‘Obiter dicta’ — things said by the way. Think of a judge saying something as an aside, not the main ruling. In R v Howe (1987), the obiter on duress not being a defence to attempted murder later became binding. ‘Noscitur a sociis’ — a word is known by its companions. If you see ‘dogs, cats, and other pets’, a tiger is excluded because of the company the word keeps. These tricks turn opaque Latin into memorable stories.

2. Criminal Law Essentials |

For actus reus, break down causation into factual (‘but for’ test — R v White) and legal (more than minimal cause — R v Kimsey). Mnemonic: ‘FLIC’ — Factual Link, Legal, Intervening act, Chain. For mens rea, distinguish intention (direct and oblique) from recklessness (Cunningham subjective recklessness vs Caldwell objective recklessness — note Caldwell overruled by R v G). Use the ‘virtual certainty’ test from R v Woollin for oblique intent: consequence was a virtual certainty and D appreciated that fact.

Defences: automatism requires total loss of voluntary control caused by an external factor (Attorney-General’s Reference (No. 2 of 1992)). Insanity uses M’Naghten Rules — defect of reason from disease of the mind causing D not to know nature/quality of act or that it was wrong. Remember ‘WRONG’ — Was it a disease of the mind? Reason defect? O Not know nature? Not know it was wrong? Good for checklist. Intoxication: specific vs basic intent crimes — DPP v Majewski. Voluntary intoxication is no defence to basic intent but may be to specific intent if it negates mens rea. Think ‘SBI’ — Specific Basic Intoxication.

(Attorney-General’s Reference (No. 2 of 1992))。 记住 ‘WRONG’ — Was it a disease of the mind? Reason defect? O Not know nature? Not know it was wrong?

3. Contract Law Vocabulary |

Offer and acceptance: an invitation to treat is not an offer. Visualise goods on a shop shelf waving a flag ‘invitation to treat’ — Pharmaceutical Society of GB v Boots Cash Chemists. Consideration must be sufficient but need not be adequate — a ‘peppercorn rent’ is enough. Link Thomas v Thomas where £1 rent sufficed. Promissory estoppel from Central London Property Trust v High Trees House: a shield not a sword. Picture a shield with ‘PE’ on it — protects a promisee who relied on a promise waiving strict rights.

Terms: condition vs warranty vs innominate term. Condition is a major term, breach allows termination — Poussard v Spiers. Warranty is minor, damages only — Bettini v Gye. Innominate term approach from Hong Kong Fir Shipping: look at effect of breach. Sing the ‘CWI’ song: ‘Condition Warranty Innominate, breach effect will determinate’. Exemption clauses: must be incorporated by signature (L’Estrange v Graucob), notice (Olley v Marlborough Court) or previous course of dealing. Then pass reasonableness test under UCTA 1977 for business-to-business or CRA 2015 for consumer. Remember ‘SINCERE’ — Signature, Notice, Course, Reasonable.

唱出 ‘CWI’ 口诀:’Condition Warranty Innominate, breach effect will determinate’。

4. Tort Law Terminology |

Negligence: duty of care uses Caparo three-stage test — foreseeability, proximity, fair just and reasonable. Imagine a ‘FPR’ triangle: Foreseeability (who could I harm?), Proximity (how close?), Reasonable (fair?). Breach: the reasonable man standard from Blyth v Birmingham Waterworks — ‘the man on the Clapham omnibus’. For professionals, Bolam test — body of responsible opinion. Damage: factual causation ‘but for’ (Barnett v Chelsea Hospital) and legal causation (remoteness — The Wagon Mound — kind of damage must be foreseeable).

损害:事实因果关系 ‘but for’ (Barnett v Chelsea Hospital) 和法律因果关系 (遥远性——The Wagon Mound——损害种类必须可预见)。

Occupiers’ liability: OLA 1957 for visitors — common duty of care. OLA 1984 for trespassers — duty only if three-part test in s.1(3) met. Mnemonic for OLA 1984: ‘Trespasser? Know or reasonable grounds to believe? Danger reasonably expected to offer some protection?’ — TKO, like a boxing knockout to remind you it’s a tough test. Nuisance: private nuisance — unlawful interference with land use or enjoyment, indirect. Sturges v Bridgman — ‘what would be a nuisance in Belgrave Square may not be so in Bermondsey’. Sensitivity of claimant matters.

Know or reasonable grounds to believe? Danger reasonably expected to offer some protection?

5. Constitutional & Administrative Terminology |

Parliamentary sovereignty: Dicey’s principle that Parliament can make or unmake any law. Visualise a crowned scroll labelled ‘Queen in Parliament’ with unlimited arrows pointing to statutes. EU law challenged this (Factortame), but after Brexit, sovereignty restored. Rule of law: Raz’s principles — law must be prospective, clear, relatively stable. Avoid arbitrary power. Easy memory: ‘PRO-CLASS’ — Prospective, Relatively stable, Open, Clear, Lawful, Accessible, Stable, Supremacy of regular law.

Judicial review: grounds — illegality (simple ultra vires A-G v Fulham Corporation), irrationality (Wednesbury unreasonableness — so outrageous no reasonable authority would make it), procedural impropriety (breach of natural justice — right to fair hearing and rule against bias). Illegality now encompasses error of law (Anisminic) and fettering discretion. Remember ‘GILIP’ — Grounds Illegality Irrationality Procedural impropriety. Or ‘Wednesbury Pie’ — Procedural impropriety, Irrationality, error of law (Extended). Proportionality: a more structured test from HRA cases — legitimate aim, rational connection, least restrictive means, fair balance. Bank Mellat refined this. Model ‘PROP 4’ — Proportional, Rational, least Onforcive, fair balance for 4 steps.

记住 ‘GILIP’ — Grounds Illegality Irrationality Procedural impropriety。或者 ‘Wednesbury Pie’ — Procedural impropriety, Irrationality, Error of law (Extended)。

6. Human Rights & EU Law Terms |

Human Rights Act 1998: section 3 — interpret legislation compatibly ‘so far as it is possible’. Section 4 — declaration of incompatibility, a ‘nuclear option’. Visualise a shield (s.3) and a megaphone (s.4) — shield protects rights by reading down; megaphone tells Parliament the law is incompatible but doesn’t strike it down. S.6 — public authorities must act compatibly. S.7 — victim test. Remember ‘3467’ — s.3 interpretation, s.4 declaration, s.6 duty, s.7 standing.

Article 8 ECHR: right to respect for private and family life. Qualified right — can be limited if in accordance with law, necessary in democratic society for legitimate aim (national security, public safety, economic well-being, prevention of crime, protection of health/morals, rights of others). Use ‘PLEASING’ — Prevention, Legal certainty, Economic, Administration, Safety-national, Interference proportionate, Necessary, Genuine aim. For Article 10 freedom of expression, similar structure. Margin of appreciation: doctrine allowing states some discretion but Court keeps supervisory role. Picture a ‘margin’ on a page where states can write within the lines before Strasbourg corrects them.

7. Remedies & Access to Justice |

Damages: compensatory aim to put claimant in position as if wrong not suffered. Types — special (quantifiable, pleaded), general (non-pecuniary, pain and suffering), aggravated (extra for injury to feelings), exemplary (punitive — Rookes v Barnard categories). Use ‘SAGE’ — Special, Aggravated, General, Exemplary. Equitable remedies: specific performance — compels performance of positive obligation (Beswick v Beswick), not for personal service or where constant supervision needed. Injunction: mandatory (require an act), prohibitory (stop an act). Account of profits: strip defendant of gain. Rescission: restore parties to pre-contractual position, available for misrepresentation. Remember ‘SPICE’ — Specific performance, Prohibitory injunction, Account, Rescission. (Need to fit P, but use ‘SPARE’ — Specific performance, Prohibitory, Account, Rescission, Ejaculatory? Better: ‘PRISM’ — Prohibitory, Rescission, Injunction mandatory, Specific performance, Money account).

ADR (Alternative Dispute Resolution): negotiation, mediation (third party facilitates), conciliation (third party suggests solutions), arbitration (binding decision). Courts encourage ADR — Halsey v Milton Keynes — can penalise refusal to mediate in costs. Judicial review remedies: quashing order (certiorari), prohibiting order (prohibition), mandatory order (mandamus), declaration, injunction, damages. The old prerogative orders: ‘C-M-P’ — Certiorari quashes, Mandamus compels, Prohibition prevents. New unified terms simpler but know both.

8. Legal System & Sources |

Precedent: ratio decidendi vs obiter dicta. Ratio is the reason for deciding, binding. Obiter is persuasive. Court hierarchy for criminal: Supreme Court (formerly HL), Court of Appeal, Crown/Magistrates’. For civil: SC, CA, High Court, county court. Remember the Appeal Court is normally bound by its own decisions (Young v Bristol Aeroplane exceptions: conflicting decisions, per incuriam, overruled by SC). Persuasive precedents: Privy Council, decisions from other common law jurisdictions. Distinguishing: a judge finds material difference in facts and avoids precedent. Reversing: appeal court changes decision in same case. Overruling: higher court overrules precedent from earlier different case. Think of a train: Distinguish (change tracks), Reverse (go backwards on same track), Overrule (smash the old rails).

Statutory interpretation: literal rule — plain ordinary meaning (Fisher v Bell), golden rule — narrow (to choose between meanings, R v Allen bigamy ‘marry’ interpreted to mean go through ceremony) and wide (modify absurd result, Re Sigsworth son who murdered mother couldn’t inherit), mischief rule — look at gap in old law, purposive approach — look at why Parliament passed the Act, EU inspired, now post-Brexit domestic (Pepper v Hart allows reference to Hansard). Mnemonic: ‘LIMP GAP’ — Literal, golden wide, golden narrow, Mischief, Purposive. Or sing ‘We will LIMP GAP you’ to Queen beat. Know intrinsic aids (within statute) and extrinsic aids (other material).

或者用皇后乐队节奏唱 ‘We will LIMP GAP you’。

9. Principles of Justice & Core Doctrines |

Natural justice: right to fair hearing (Ridge v Baldwin) and rule against bias (pecuniary, personal, policy bias). Some cases require duty to give reasons. Visualise two pillars of a temple: ‘Audi alteram partem’ (hear the other side) and ‘Nemo judex in causa sua’ (no one a judge in his own cause). Separation of powers: Montesquieu’s three branches — legislature, executive, judiciary. In UK fusion of legislature/executive but judiciary independent since CRA 2005. Use story ‘LEJ’ — Legislature makes, Executive executes, Judiciary judges. Justice should be blindfolded.

Equity: body of rules that grew up to mitigate harshness of common law. Maxims: ‘He who comes to equity must come with clean hands’, ‘Equity will not suffer a wrong to be without a remedy’, ‘Equity follows the law’, ‘Delay defeats equity’. These are frequently examined. Link each maxim to a film scene: cleaning hands in a sink before entering chancery; a superhero arriving at last minute to provide a remedy; a shadow copying a statue; a snail slowly crossing a finish line and losing. In trust law, know the three certainties: intention, subject matter, objects — ‘ISO’ like film speed. For resulting and constructive trusts, use diagram of arrows moving backwards (resulting) or building blocks (constructive).

10. Quick Revision Mnemonics Toolkit |

Develop personalised mnemonic charts for each topic. Use the ‘Acronym & Story’ method: for murder AR = ‘UPC’ — Unlawful killing, Person, Causation. MR = ‘IM’ — Intention to kill or cause GBH. For theft AR = ‘APP’ — Appropriation, Property, Property belonging to another. MR = ‘DIP’ — Dishonesty, Intention to permanently deprive. Construct vivid image: a thief with a dip bowl (DIP) dipping an apple (APP) into chocolate. Test for dishonesty from Ivey v Genting: was conduct dishonest by ordinary standards and did D realise that? Use ‘Ivey’s Dishonesty Diet’ — Ordinary Standards then Knowledge.

犯罪意图 = ‘IM’ — Intention to kill or cause GBH (杀人或重伤故意)。盗窃罪犯罪行为 = ‘APP’ — Appropriation (占有)、Property (财产)、Property belonging to another (他人财产)。

For sentencing aims: ‘PRDRC’ — Punishment, Reduction of crime (deterrence), Rehabilitation, Denunciation, Reparation, Capital? No, replace Capital with protection of public, so ‘PRDRP’ — Punishment, Reduction, Denunciation, Rehabilitation, Protection. Or use ‘5 aims’ song: ‘You oughta know’ — Punishment, Reduction, Reformation (rehabilitation) Reparation, protection of Public. Flashcard pairs: write term on front, definition and case on back. Use Leitner box system: cards correct move to next box, incorrect go back. On test day, recall images not just words.

You oughta know’——Punishment, Reduction, Reformation (rehabilitation) Reparation, protection of Public。

11. Commonly Confused Term Pairs |

(a) Common law vs statute law: common law is judge-made, statute is made by Parliament. Visualise a judge’s wig vs a green Act of Parliament paper. (b) Ratio decidendi vs obiter dicta: ratio = binding; obiter = persuasive. Think ‘Rope’ — Ratio binds like rope; Obiter floats like a bubble. (c) Criminal vs civil standard of proof: criminal ‘beyond reasonable doubt’ (stern judge pointing), civil ‘on the balance of probabilities’ (scales tipping). Use hand gesture: criminal — solid fist; civil — open palm weighing. (d) Direct vs oblique intent: direct = aim/purpose; oblique = almost certain and knows it. Imagine shooting an arrow straight at target (direct) vs closing eyes and spinning, almost certain to hit something (oblique).

(e) Void vs voidable: void contract is never valid (ab initio); voidable is valid until set aside. Compare a dead tree (void) vs a sick tree that can be cured or cut down (voidable). In misrepresentation: fraudulent, negligent, innocent — remedies differ; rescission available for all, damages vary. (f) Duress vs undue influence: duress = threats; undue influence = improper pressure without threats (RBS v Etridge). Think of a gun (duress) vs a whispered manipulation (undue influence). (g) Corporate liability: vicarious vs direct. Vicarious liability: employer liable for employee’s torts committed in course of employment. Use ‘Close connection’ test from Lister v Hesley Hall. Visualise a connecting chain.
