1. Parliamentary Law Making |

Parliament is the supreme law-making body in the UK, guided by the doctrine of parliamentary sovereignty. The legislative process involves several stages in both the House of Commons and the House of Lords before a Bill receives Royal Assent and becomes an Act of Parliament.

The first reading is a purely formal introduction of the Bill with no debate. The second reading involves a full debate on its general principles and a vote.

At the committee stage, a detailed clause-by-clause examination takes place, often in a Public Bill Committee. The report stage allows further amendments before the third reading, where the final version is approved.

The House of Lords can scrutinise and propose amendments, but the Parliament Acts 1911 and 1949 limit its power to block legislation. Once both Houses agree, the monarch grants Royal Assent, a formality that makes the Bill law.

2. Delegated Legislation |

Delegated legislation is law made by persons or bodies to whom Parliament has delegated authority. It includes Orders in Council, statutory instruments, and by-laws, each serving distinct purposes and subject to different controls.

Orders in Council are made by the Privy Council and are often used in emergencies or to transfer ministerial responsibilities. Statutory instruments, the most common form, are drafted by government ministers to implement the detail of an Act.

By-laws are created by local authorities or public corporations to regulate matters in their areas, such as parking restrictions or park rules. All forms of delegated legislation are subject to parliamentary and judicial controls to prevent abuse of power.

Parliamentary controls include the negative resolution procedure, the affirmative resolution procedure, and scrutiny by the Joint Committee on Statutory Instruments. Judicial controls include the ultra vires doctrine, which renders void any delegated legislation that exceeds the powers granted by the parent Act.

3. Judicial Precedent |

Judicial precedent, or stare decisis, is the principle that courts must follow decisions of higher courts in similar cases. This doctrine ensures consistency, predictability, and fairness in the common law system.

The hierarchy of courts determines which decisions are binding. Decisions of the Supreme Court (formerly the House of Lords) bind all lower courts, while the Court of Appeal is bound by the Supreme Court but binds the High Court and lower courts.

The ratio decidendi is the legal reasoning essential to the decision and forms the binding precedent. Obiter dicta, remarks made by the way, are persuasive but not binding, though they may later be adopted as ratio.

The Supreme Court can depart from its own previous decisions using the Practice Statement 1966, but this power is used sparingly. Lower courts can distinguish cases on material facts or overrule a decision if it was made per incuriam (through lack of care).

4. Statutory Interpretation |

When the meaning of a statute is unclear, judges use rules of interpretation to determine Parliament’s intention. The three traditional rules are the literal rule, the golden rule, and the mischief rule, supplemented by the purposive approach.

The literal rule requires courts to give words their plain, ordinary dictionary meaning, even if the result is absurd. The golden rule modifies the literal meaning to avoid an absurd outcome, applying either a narrow or wide approach.

The mischief rule, established in Heydon’s Case, examines the common law before the Act, the defect Parliament intended to remedy, and how the Act seeks to cure that defect. The purposive approach, influenced by EU jurisprudence, looks at the broader purpose of the legislation.

Judges also rely on intrinsic aids (within the Act itself) and extrinsic aids (external materials such as Hansard, dictionaries, and Law Commission reports) to resolve ambiguity.

5. Influence of European Union Law |

Until Brexit, EU law was a primary source of law in the UK. The European Communities Act 1972 gave direct effect to EU treaties and regulations, while directives required domestic implementation.

EU legislation and decisions of the Court of Justice of the European Union (CJEU) were binding on all UK courts, often overriding conflicting domestic laws under the principle of primacy. The purposive approach to interpretation became prominent.

Following the European Union (Withdrawal) Act 2018, retained EU law was incorporated into UK law at the end of the transition period. Courts may now depart from retained CJEU case law under specified conditions, but a new legal landscape continues to evolve.

The impact of EU law on UK legal methods—particularly statutory interpretation and judicial reasoning—remains significant in the post-Brexit era, especially in areas like employment and consumer protection.

6. Tort of Negligence: The Duty of Care |

Negligence is a tort that imposes liability for careless conduct causing damage. To establish negligence, the claimant must prove that the defendant owed them a duty of care, breached that duty, and caused foreseeable damage.

The neighbour principle from Donoghue v Stevenson established that one must take reasonable care to avoid acts or omissions likely to injure a neighbour—persons closely and directly affected by the conduct.

Donoghue v Stevenson

The modern three-stage test from Caparo Industries v Dickman asks: was the damage reasonably foreseeable? Was there sufficient proximity between the parties? Is it fair, just and reasonable to impose a duty?

Caparo Industries v Dickman

Special duty situations include liability for omissions, acts of third parties, and public bodies. Generally, there is no duty to act, but exceptions exist when a special relationship or control is assumed.

7. Breach of Duty and Causation |

Breach of duty occurs when a defendant falls below the standard of care expected of a reasonable person. The standard is objective, but may be adjusted for factors such as age, special skill, or the magnitude of risk.

Courts balance the risk factors identified in Bolton v Stone: the likelihood of harm, the seriousness of potential injury, the cost and practicality of precautions, and the social utility of the defendant’s conduct.

Causation requires both factual causation, established by the ‘but for’ test (Barnett v Chelsea & Kensington Hospital), and legal causation, where the defendant’s breach must be a more than minimal cause with no intervening act breaking the chain.

The thin skull rule states that a defendant must take the victim as found, meaning they are liable for unforeseen additional harm due to a pre-existing condition. Remoteness of damage limits liability to consequences that are reasonably foreseeable in kind, as in The Wagon Mound.

8. Psychiatric Harm and Pure Economic Loss |

Recovery for psychiatric harm in negligence is limited by policy-driven control mechanisms. Primary victims, who are directly involved in a traumatic event, are owed a duty without additional restrictions.

Secondary victims, witnesses to an event, must satisfy the Alcock criteria: a close tie of love and affection, proximity in time and space, perception by personal senses, and a sudden shocking event.

Pure economic loss not consequent upon physical damage is generally irrecoverable unless a special relationship of assumption of responsibility exists, as in Hedley Byrne v Heller. Policy reasons restrict claims to avoid indeterminate liability.

Understanding the difference between consequential economic loss (recoverable) and pure economic loss (generally not) is crucial for exam application and essay analysis.

9. Defences and Remedies in Tort |

Even if negligence is established, a defendant may rely on defences such as contributory negligence, voluntary assumption of risk (volenti non fit injuria), and illegality. These may reduce or completely bar a claim.

Contributory negligence under the Law Reform (Contributory Negligence) Act 1945 allows damages to be reduced by the percentage the claimant is at fault. Volenti requires full knowledge and willing acceptance of the risk, as in sports cases.

The main remedy in tort is damages, which aim to put the claimant in the position they would have been in but for the tort. Special damages cover quantifiable losses, while general damages compensate for pain, suffering, and loss of amenity.

Other remedies include injunctions, which are equitable orders to do or refrain from doing something, available at the court’s discretion when damages are inadequate.

10. Criminal Law: Actus Reus and Omissions |

In criminal law, liability generally requires both an actus reus (guilty act) and mens rea (guilty mind) coinciding in time. The actus reus includes conduct, consequences, and surrounding circumstances specified in the offence definition.

Actus reus must be voluntary. Acts done under duress or in a state of automatism may not satisfy this requirement. The prosecution must prove that the defendant’s conduct caused the prohibited result.

Liability for omissions is exceptional in English law. A defendant is only liable for failing to act when a duty to act is recognised—by statute, contract, special relationship, assumption of care, or creation of a dangerous situation.

Key cases include R v Gibbins and Proctor (parental duty), R v Stone and Dobinson (assumption of care), and R v Miller (creating a dangerous situation). These illustrate the boundaries of omission liability.

典型案例包括 R v Gibbins and Proctor(父母责任)、R v Stone and Dobinson(承担照顾义务)和 R v Miller(造成危险情形),这些案例展示了不作为责任的边界。

11. Mens Rea and Transferred Malice |

Mens rea refers to the mental element of a crime. The main levels are intention (direct and oblique), recklessness (subjective Cunningham test), and, in some statutory offences, negligence or gross negligence.

Direct intention exists when the defendant desires the consequence. Oblique intention arises when the consequence is a virtual certainty and the defendant appreciates that, as established in R v Woollin.

Recklessness involves taking an unjustified risk of which the defendant was aware. Coincidence of actus reus and mens rea can be satisfied under the continuing act doctrine (Fagan v MPC) or the series of acts approach.

Transferred malice applies when the mens rea intended for one victim is transferred to an unintended victim of the same type of crime (R v Latimer). It does not transfer across different offences.

12. Non-fatal Offences and General Defences |

The main non-fatal offences against the person are assault, battery, assault occasioning actual bodily harm (s47 Offences Against the Person Act 1861), malicious wounding or inflicting grievous bodily harm (s20), and causing grievous bodily harm with intent (s18).

Assault is causing another to apprehend immediate unlawful force; battery is the actual infliction of unlawful force. Consent, self-defence, and intoxication are among the key defences that may negate liability for these offences.

Self-defence requires the use of reasonable force in the genuine belief of necessity, judged subjectively as to the belief and objectively as to proportionality. Intoxication can negate specific intent crimes but not basic intent crimes under the Majewski rule.

Consent is a defence to minor harms but not to actual or grievous bodily harm unless it falls within public interest exceptions, such as surgery, sport, or tattooing.
