Application: The actus reus of murder is clearly established: David struck Mark with a heavy ashtray, causing a brain haemorrhage that led to death. Factual causation exists but-for the blow, and legal causation is satisfied as the blow was more than a minimal cause of death and no intervening event broke the chain. Regarding mens rea, a heavy ashtray used against the head suggests an intention at least to cause really serious harm. The natural consequence of such a blow is GBH, and it is virtually certain. The jury is likely to infer intent. However, loss of control must be considered. The insult about David’s girlfriend might amount to a qualifying trigger as ‘things said or done which constituted circumstances of an extremely grave character and caused D to have a justifiable sense of being seriously wronged’ (s.55(4)). Yet the court may find that a person with normal tolerance would not have reacted with lethal violence to an insult. The defence is arguable but by no means guaranteed. No other partial defence appears relevant.
