1. Criminal Liability Equation | 刑事责任等式

The universal starting point for any criminal offence. Unless the question concerns a strict liability crime, you must prove both the actus reus (guilty act) and mens rea (guilty mind), and then consider whether a valid defence applies.

Actus reus can consist of an act, an omission (where a duty exists), or a state of affairs. Mens rea varies by offence and includes intention, recklessness, negligence, or knowledge. The prosecution must prove both elements beyond reasonable doubt, and the defendant may escape liability by raising a full defence such as self-defence or insanity.

2. Mens Rea Cheat Sheet | 犯罪意图速查表

Mens rea is the mental element required for a particular crime. Different offences demand different levels of fault. Use the table below to identify the required mens rea for common AS-level offences.

When using the table, remember that recklessness for non-fatal offences is subjective (Cunningham): the defendant must have foreseen the risk of the prohibited consequence and gone on to take it unreasonably. For criminal damage, recklessness may be assessed under the objective test in R v G.

3. Causation Formula | 因果关系公式

For result crimes (e.g., murder, manslaughter, s.47 ABH) the prosecution must prove that the defendant’s actus reus caused the prohibited consequence. The law uses a two-stage test.

Factual Causation (‘But For’ Test) + Legal Causation (Substantial and Operating Cause) = Causation Established

Factual causation: ask ‘but for the defendant’s conduct, would the result have occurred?’ If the answer is ‘no’, factual causation is satisfied (R v White). Legal causation requires the defendant’s act to be a substantial (more than minimal) and operating cause of the result. In R v Smith the defendant’s stabbing was still an operating cause despite poor medical treatment, because the original wound remained a substantial factor.

An intervening act (novus actus interveniens) can break the chain of causation, but only if it is free, voluntary and informed (R v Kennedy), or an unforeseeable natural event. Medical negligence rarely breaks the chain unless ‘palpably wrong’ and independent of the original injury (R v Cheshire). The victim’s own acts (e.g., refusing treatment) do not necessarily break the chain; you must assess whether the injury remained an operative and significant cause.

4. Strict Liability Formula | 严格责任等式

Strict liability offences do not require proof of mens rea for at least one element of the actus reus. They are usually regulatory or public safety crimes. The prosecution only needs to show the defendant performed the prohibited act.

Actus Reus (no MR required for a key element) + No Due Diligence Defence (if offence is absolute) = Strict Liability

Courts presume mens rea is required unless the statute clearly excludes it (Sweet v Parsley). Factors pointing to strict liability include: the offence is regulatory, carries a small penalty, concerns public safety, and the wording of the statute omits words like ‘knowingly’. For example, driving without insurance is a strict liability offence. However, some strict liability offences allow a defence of ‘due diligence’ or ‘no fault’, which can be expressed in the formula as a conditional subtraction.

AQA AS Law examines the hierarchy of non-fatal offences against the person under the Offences Against the Person Act 1861 and the common law. Each offence can be reduced to an equation linking actus reus and mens rea.

For ABH, ‘actual bodily harm’ includes any hurt or injury calculated to interfere with the health or comfort of the victim (R v Miller), including psychiatric injury. Note that s.20 GBH uses ‘inflict’ which can include indirect harm (R v Martin), while s.18 requires ’cause’ and specific intent. The ladder of seriousness runs assault → battery → s.47 ABH → s.20 GBH → s.18 GBH, each requiring an extra element or a higher mens rea.

6. Negligence Liability Framework | 过失侵权责任框架

In tort law, a claim in negligence follows a structured four-step ‘formula’. A claimant must prove each component on the balance of probabilities. If any element fails, the claim fails.

Duty of Care (Caparo) + Breach of Duty (Reasonable Person) + Causation (Factual & Legal) + Remoteness (Foreseeable Kind of Damage) = Negligence Liability

Each stage operates as a filter. Duty of care asks whether the defendant ought to have had the claimant in contemplation. Breach examines whether the defendant fell below the standard of the reasonable person. Causation requires the breach to be both a factual cause and a legal cause of the damage. Remoteness limits liability to damage of a type that was reasonably foreseeable at the time of the breach (The Wagon Mound No 1).

The leading case Caparo Industries v Dickman established a tripartite test for novel duty situations. Where no precedent exists, apply this test to determine whether a duty of care should be imposed.

Foreseeability of Harm + Proximity + Fair, Just and Reasonable = Duty of Care

Foreseeability: would a reasonable person in the defendant’s position have foreseen that the claimant might be injured by their conduct? Proximity: there must be a sufficiently close relationship between the parties, either physical, relational or causal. Fair, just and reasonable: the court considers policy factors, including the floodgates argument and whether imposing a duty would cut across a statutory scheme (Robinson v Chief Constable of West Yorkshire Police). This test must be applied incrementally by analogy with established categories.

8. Breach of Duty and the Reasonable Person | 违反义务与理性人

Once a duty is established, the court asks whether the defendant has fallen below the standard of the ordinary reasonable person in the defendant’s circumstances. This is an objective test.

Standard of Care = Reasonable Person in D’s Position, taking into account: Likelihood of Harm × Potential Severity – Cost of Precautions – Social Utility

The court weighs the risk factors identified in Bolton v Stone and Paris v Stepney Borough Council: a higher likelihood of injury and greater potential severity demand higher precautions. However, the cost of taking precautions and the social utility of the defendant’s activity may lower the standard (Watt v Hertfordshire County Council). Special standards apply to professionals (Bolam test: a practice accepted as proper by a responsible body of professional opinion) and learners (the standard of the ordinary competent adult; Nettleship v Weston). Children may be judged against the standard of a reasonable child of the same age (Mullin v Richards).

After proving breach, the claimant must link the breach to the damage suffered. Tort law uses a similar two-stage causation test as criminal law but applies the balance of probabilities and the concept of remoteness to limit recovery.

证明违反后,原告须将违反与所受损害关联起来。侵权法采用与刑法类似的二阶因果关系检验,但适用盖然性衡量,并以遥远性概念限缩赔偿范围。

Factual causation is tested by the ‘but for’ test: but for the defendant’s breach, would the claimant have suffered the loss? For multiple causes, the court may apply the ‘material contribution’ approach where the but-for test is impossible to satisfy (Bonnington Castings v Wardlaw). Legal causation requires no break in the chain; an intervening act must be unforeseeable and independent. Remoteness means the type of damage (not the extent) must have been reasonably foreseeable at the time of the breach (The Wagon Mound No 1). The thin skull rule provides that the defendant must take the victim as found, so unforeseeable extent of injury is recoverable.

Even when all elements of an offence or tort are proven, the defendant may avoid liability by raising a successful defence. This section lists the key defences and their core requirements in equation form.

Self-Defence (Criminal) = Honest belief in need for force + Reasonable force in the circumstances as D believed them to be

Remember that consent can be used as a defence to assault and battery if the contact is within the bounds of everyday life or a recognised sporting context. In tort, consent (volenti non fit injuria) provides a complete defence if the claimant freely and voluntarily accepted the risk of harm. Intoxication is a complex area: self-induced intoxication is no defence to basic intent crimes such as s.47 ABH or s.20 GBH because getting intoxicated is itself reckless. For specific intent crimes like murder or s.18 GBH, intoxication may prevent the defendant from forming the required intent, leading to a substituted verdict (e.g., manslaughter instead of murder).
