Understanding this hierarchy is vital because a court is generally bound by decisions of courts above it, and appellate courts are usually bound by their own past decisions. In addition to these rules, judges use a range of aids to interpretation. Intrinsic aids are found within the statute itself, such as the long title, preamble, marginal notes, and headings. There are also presumptions, such as the presumption against criminal liability without mens rea, and rules of language, like ejusdem generis (words following a list are interpreted as of the same kind) and noscitur a sociis (a word is known by its accompanying words).

The Supreme Court, since the Practice Statement of 1966, may depart from its own previous decisions when it appears right to do so, though it does so sparingly to maintain certainty. The High Court is bound by the Court of Appeal and Supreme Court but not by other High Court decisions, though they are strongly persuasive.

Certain reforms, such as allowing majority verdicts (10-2 or 11-1) and the possibility of trial without a jury in cases of serious risk of tampering, have been introduced to address these issues.
