The force must be more than minimal and be used to complete the theft.

Consent provides a defence to battery and, in limited areas such as sport or surgery, to actual bodily harm; but cannot generally be a defence to more serious injury. Intoxication distinguishes voluntary intoxication, which is only a defence to crimes of specific intent where it negates the required mens rea, from involuntary intoxication, which can provide a wider defence.

To establish negligence, a claimant must prove duty of care, breach of that duty, and damage caused by the breach. Duty is tested by the Caparo three-stage test: foreseeability of harm, proximity between the parties, and whether it is fair, just and reasonable to impose a duty. Breach is assessed against the standard of the reasonable person, considering factors such as the likelihood of harm, the seriousness of potential injury, the cost of taking precautions, and any social utility of the defendant’s activity (as seen in Watt v Hertfordshire).

Volenti non fit injuria (voluntary assumption of risk) is a complete defence where the claimant freely consented to the risk of injury with full knowledge of its nature and extent. Contributory negligence, under the Law Reform (Contributory Negligence) Act 1945, reduces damages by the proportions of the claimant’s own fault but does not defeat the claim entirely. The primary remedy in tort is compensatory damages, aiming to restore the claimant to their pre-tort position, while an injunction may be granted to prevent a continuing or anticipated tortious act.
