A critical distinction: ABH uses ‘occasioning’ and requires proof of causation between the base assault/battery and the harm. S.20 GBH requires the defendant to ‘wound or inflict’ GBH, while s.18 requires ‘wounding or causing’ GBH with a specific intent that makes it the most serious and carries a maximum life sentence.

Robbery is theft with force or threat of force immediately before or at the time of stealing: Theft + Force/Putting in Fear = Robbery. Burglary under s.9(1)(a) is entry into any building/part of a building as a trespasser with intent to commit theft, GBH, or criminal damage. S.9(1)(b) adds actually committing those offences after entry.

Duress cannot be used for murder, attempted murder, or certain treason offences.

Establishing a duty of care is the gateway to a negligence claim. The Caparo test synthesises earlier rulings into a flexible tool that the courts refine case by case. Once a duty is found, the standard of care is measured objectively, and the circumstances determine whether the defendant fell below that standard.

Intention to create legal relations is presumed in commercial agreements and presumed absent in domestic arrangements, though the presumptions are rebuttable by evidence.
