For battery, the actus reus is the infliction of unlawful personal force on another, the slightest touch sufficiency. Tom sustained a cut, which is an injury flowing from the original threat and the immediate physical context, but it could be argued that Dan did not directly apply force; Tom fell because he stumbled. However, if Dan’s actions caused Tom to retreat and he was hurt as a direct and immediate result, battery may still be established on a causation basis (Roberts 1971). The mens rea for battery is the same as for assault. Thus, Dan is likely to be liable for both offences.

To establish negligence, Leo must prove that SuperShop Ltd owed him a duty of care, breached that duty, and that the breach caused the damage which was not too remote. As a customer, Leo is clearly owed a duty of care by the occupier of the premises (following Donoghue v Stevenson 1932 and the Occupiers’ Liability Act 1957). The employer is vicariously liable for Mia’s acts committed in the course of employment. The standard of care is that of a reasonable employee; failing to put out a wet-floor sign after mopping a known spillage almost certainly falls below that standard.

Therefore, it is highly likely that a court would find SuperShop Ltd liable for negligence, and Leo would be awarded damages for his broken wrist.
