1. The UK Constitution |

The UK constitution is uncodified, meaning it is not written down in a single document. It derives from statute law, common law, conventions, authoritative works, and EU law (though EU law no longer binds the UK post-Brexit). This flexibility allows the constitution to evolve without formal amendments, but critics argue it lacks clarity and entrenched rights.

Key sources:

  • Statute law: Acts of Parliament such as the Human Rights Act 1998.
  • Common law: judicial precedent created by court rulings.
  • Conventions: unwritten practices like the monarch appointing the leader of the largest party as Prime Minister.

2. Parliamentary Sovereignty |

Parliament is the supreme legal authority in the UK. It can make or unmake any law, and no body can override its legislation. This principle underpins the relationship between the legislature and the courts. However, membership of the EU qualified sovereignty, and the devolution of powers to Scotland, Wales, and Northern Ireland has introduced shared rule, though Parliament legally retains the right to reclaim those powers.

  • Dicey’s theory: no Parliament can bind its successors.
  • Exceptions: devolution statutes, the Human Rights Act (which courts can use to issue declarations of incompatibility), and the rule of law.

3. The Monarchy | 君主制

The UK is a constitutional monarchy. The monarch is Head of State but acts on the advice of ministers. Royal prerogative powers are exercised by the Prime Minister and cabinet in the monarch’s name. In practice, the monarch’s role is ceremonial and symbolic, including the State Opening of Parliament and giving Royal Assent to legislation, which is a formality.

The monarch must remain politically neutral. The last refusal of Royal Assent was in 1708, establishing the convention that the monarch does not block laws passed by Parliament.

4. The Prime Minister and Cabinet |

The Prime Minister is the head of government, appointed by the monarch as the MP who commands the confidence of the House of Commons. Key powers include appointing and dismissing ministers, chairing the cabinet, setting the government’s policy agenda, and representing the UK internationally. Cabinet government means decisions are collectively made, but in practice the PM often dominates.

Collective ministerial responsibility – all cabinet members must publicly support government policy or resign. Individual ministerial responsibility – ministers are accountable to Parliament for their own and their department’s actions.

5. The House of Commons | 下议院

The House of Commons is the elected lower house of Parliament, composed of 650 Members of Parliament (MPs). It is the primary legislative chamber, where bills are debated and scrutinised. MPs represent constituencies and are elected through the first-past-the-post system. The Commons also holds the government to account through questions, debates, and select committees.

The Speaker maintains order, and the government sits on the front benches while opposition parties sit opposite. The official Opposition, the second-largest party, forms a Shadow Cabinet.

6. The House of Lords | 上议院

The House of Lords is the unelected upper chamber. Its members include life peers appointed for their expertise, 92 hereditary peers, and 26 bishops of the Church of England. The Lords revises and scrutinises legislation, often suggesting amendments, but the Commons can override its veto through the Parliament Acts 1911 and 1949. The chamber also acts as a check on government through debates and committee work.

Reform of the Lords remains a political issue; proposals range from full election to a smaller, appointed chamber.

7. The Legislative Process |

A bill must pass through several stages in both Houses before becoming law. In the House of Commons, the typical stages are: First Reading (formal introduction), Second Reading (main debate on principles), Committee Stage (detailed clause-by-clause scrutiny), Report Stage (further amendments), and Third Reading (final approval). It then moves to the Lords, and any amendments ping-pong between the chambers until agreement is reached. The monarch grants Royal Assent, and the bill becomes an Act of Parliament.

8. Electoral Systems |

The UK uses different voting systems for different elections. The key systems are:

  • First-past-the-post (FPTP): used in Westminster general elections. Voters choose one candidate; the candidate with the most votes wins, even if without a majority. It tends to produce strong single-party government but can distort the popular vote share.
  • Additional Member System (AMS): used for the Scottish Parliament and Welsh Senedd. Voters have two votes: one for a constituency MSP under FPTP, and one for a regional party list to adjust proportionality.
  • Single Transferable Vote (STV): used in Northern Ireland Assembly elections. Voters rank candidates in multi-member constituencies; a quota determines winners, achieving high proportionality.

System Proportionality Used in
FPTP Low UK Parliament
AMS Medium Scotland/Wales
STV High Northern Ireland

9. Political Parties in the UK |

The main parties are the Conservative Party (centre-right, emphasising free markets, traditional values, and strong national defence), the Labour Party (centre-left, focusing on social justice, public services, and workers’ rights), and the Liberal Democrats (centrist, supporting civil liberties, electoral reform, and a mixed economy). Regional parties include the SNP in Scotland and Plaid Cymru in Wales, both advocating independence.

Parties perform functions: representing citizens, formulating policies, recruiting leaders, and forming governments. The UK is effectively a multi-party system at the devolved level, but FPTP maintains two-party dominance at Westminster.

10. Devolution |

Devolution transfers certain powers from Westminster to regional governments without Parliament losing sovereignty. Scotland, Wales, and Northern Ireland each have their own parliament or assembly with varying degrees of legislative competence. Scotland has primary legislative powers over areas like health and education, while Wales initially had secondary powers but now also holds primary legislative authority. Northern Ireland’s devolution operates under power-sharing arrangements.

England lacks a separate parliament; some regions have combined authorities with elected mayors, a form of devolution often called the “English devolution deal.”

11. The Judiciary |

The judiciary is independent of the executive and legislature. The Supreme Court, established in 2009, is the highest court in the UK, taking over the appellate function from the House of Lords. Its role includes interpreting the law, reviewing the legality of government actions (judicial review), and ensuring compatibility with human rights legislation. Judicial independence is underpinned by security of tenure and the separation of powers.

The Constitutional Reform Act 2005 enhanced the separation by removing the Lord Chancellor’s combined role and creating a new Supreme Court.

12. Rights and Protections |

The main legal instruments protecting individual rights in the UK are the Human Rights Act 1998, which incorporates the European Convention on Human Rights into domestic law, and the Equality Act 2010, which consolidates anti-discrimination law. Citizens can seek redress in UK courts, which can issue a declaration of incompatibility if primary legislation conflicts with Convention rights. However, Parliament is not forced to amend the law.

Other protections arise from common law, such as the right to a fair hearing and the presumption of innocence. Pressure groups and the media also play a role in defending rights.
